dla piper is one the worst firms to do discovery shit with, epsecially e-discovery. these emails must've been turned over by earl or another disgruntled former assoc right? no fucking way did dla piper turn these over in some rfp "all emails relating to billing plaintiff."

The matter was being handled by a seventh year associate who probably had a bunch of ther shit going on and decided to mail it in on this matter because it wasn't billable. Whoops.

bro seriously. was there discovery shit in front of the magistrate? i can't imagine they held onto this on their server. you think the other side won a motion to get a forensic comp sci dork in their building to look for emails with certain search terms?

What's the alternative, that one of the recipients of the smoking gun emails emailed them in to the plaintiff? They're all lawyers and they could all seriously fuck themselves for having done so.

let's say you're an associate sending them email. the receiver finds you after the suit is filed and says "bro, i deleted my email, you took it out of your sent file, right?"

what happens?

Bro I really have no idea what you're talking about here but maybe that's because I'm not a litigation masterman. Given the stuff i've read, the most likely explanation to me was that DLA tossed this at an associate on partner track, he mailed it in and decided to do a document dump that ended up fucking him in the ass. And yes, I do think DLA would have had these emails on their server. I know my firm would have. So all it would have taken was a doc request with the relevant attorneys' names and dates. I think that's more plausible than one of the recipients, who presumably no longer works there, knowing about the suit and sending these incriminating emails to the plaintiff.

you seriously think they would admit to the email's existence and not say "RFP 12) attached find 4,651 emails to and from john smith containing the term "widgets 123?"

Dude, again, I'm not a lit masterman, but the fucking article itself says the emails were included in 250,000 pages of docs turned over by DLA.
