The authority given to the Supreme Court by the act establishing the judicial system of the United States to issue writs of mandamus to public officers appears not to be warranted by the Constitution.

It is emphatically the duty of the Judicial Department to say what the law is. Those who apply the rule to particular cases must, of necessity, expound and interpret the rule. If two laws conflict with each other, the Court must decide on the operation of each.

You still around? I was curious what you'd think about this situation. We had a recent appellate argument against the government. In years of litigation, the government has never cited any authority in support of a legal argument it kept making. It never cited any in its responsive brief. Then, for the first time ever, in oral argument, it whips out a footnote in a case which seems to support its theory, and we're caught completely off guard. Of course we have ways to distinguish it now, but werent able to do it in oral argument because it was never cited before. Are we just fucked?
