Your fucked. Fed courts isn't one of those classes you can learn over a day or so. Need at least a couple weeks to fully grasp the material. I hope you a 3L that's biglaw secure.

well my problem is that i sort of have an idea of how to identify issues in an issue spotter (just looked up one of his old exams), but none of the cases or policy arguments stick in my memory. it's not like i blew this class off; i didn't try particularly hard, but i didn't miss too many classes either.

3L, no biglaw. district court clerkship though, which is why i had to take this trainwreck of a class.

Oh, then you'll be fine. They ain't gonna take away your clerkship if you fuck up. In any event, a guy like you probably has the natural ability to do good in classes, and you probably study harder for classes then you think you do.

On a side note, why no biglaw if you had stats to get a clerkship?

thanks, i've definitely slacked before and been fine, but this class just feels different. hope that it's just paranoia.

really hated law school 1L, so mentally checked out and was pretty set on dropping out. still managed above median, so i thought i'd stick it out. wrote onto LR and crushed it 2L, went from just above median to top 10%. so my stats during oci and stats during clerkship hiring were drastically different. you also a 3L?

Yeah, I'm a 3L with biglaw. I'd say I'm the opposite of you and have been going downhill since 1L.

You got any tips for a buddy of mine. He's at a TTT (not a full on TTT, but like a top 50 TTT),and had a shitty 1L year, but is now something like top 5% and still hasn't found a job. He couldn't get a clerkship either, but he didn't have LR.

nice, so you put in the effort when it counted and slacked when it didn't. really wish i had done the same, but no use in dwelling on the past.

one important thing for your buddy is to come up with a good story for why he didn't get biglaw before. when i was interviewing for a couple biglaw positions before landing the clerkship, i was surprised that they asked this. i just thought that they would look at my transcript, see that my grades improved, and assume that i couldn't get biglaw during oci. but apparently some interviewers just see your class rank and don't think too much beyond that.

another is to let everyone know that you're looking for a job. it's tough because there's obviously a lot of embarrassment associated with not having anything locked up before graduation, but so many people are willing to hook you up as long as they know your situation. and it's usually much easier than the garden variety networking flame, because your friend/family member usually tells the contact that you're looking for a job, so you don't need to play the whole "i just wanted to chat with you about your career" game.

kinda simple stuff, but hopefully it helps.

actually 11th amendment stuff seems to be the only thing that stuck for some reason. probably because it involves more technical application and less policy bullshit.

the areas that i'm really unsure on are congressional power to expand/restrict jurisdiction and supreme court review of state decisions. like if you had to give me 1-2 sentence summaries of the important points in these areas, what would they be?

Really simplified, but for the latter point -- for Article III judicial review to mean anything, SCOTUS review must extend to state courts (Hunter's Lessee). Adequate and independent state court doctrine (Michigan v. Long). Supremacy Clause ftw (Cooper v. Aaron).

Yeah man. It's basically going into the exam with your answers already written.

Use the left column as a checklist for spotting issues. For every plausible issue you find, copy the rule statement verbatim and plug the right facts into the "analysis" part of (I)RAC. Conclude as appropriate.
