Yesterday I asked why a government couldn't legitimately kill its own citizens. Many of you cited the 8th amendment as an independent restriction on government power. But why should we think a document is itself legitimate? What is legitimacy?

best argument i've heard so far. but then of course, if it's a contract why can't citizens opt out? You might argue they can -- but US citizens by birth don't have much say in the matter.

you're born into the contract. i guess the argument is your mom had gov't protection to gestate you safely and the docs/nurses delivered you without you dying and by the time you learn enough to opt out you owe the public school system, the fed gov't (roads), and local police for allowing the indulgence to study over engaging in child labor or being a child soldier.
