A good friend of mine and I both interviewed and were selected as finalists before Avue changed but we have not heard anything from EOIR.
For anyone with offers (or not) have your references been contacted? Ours have not (that we know of).

I still haven't heard anything and I don't even know if I'm a finalist. It seems odd we can no longer check to see if we are finalists on Avue. Has anyone contacted the helpdesk for Avue?
By the way, I think they contact references as one of the last things they do before they give an offer. I know a SLIP from last year who got his references called one day and the next day got an offer.

Congrats to those with offers!
I just got an E-mail that said the first round is all out and the second round won't happen until the FY2010 budget passes--I assume the other non-offered finalists got this too? Kinda sucks, but at least there's still hope, I guess.

Greetings,
You have been designated as a finalist for an EOIR clerkship, as indicated by your online AVUE status. As was mentioned during your interview, many of the 2010-2012 positions are budget dependent. Congress has not yet passed the FY2010 budget and we do not know the timeline. First-round offers for the existing positions have been extended; we anticipate making a second round of offers after the budget passes. Generally, we anticipate extending offers through early 2010. We will keep you apprised of developments. In the meantime, please respond to me via email if you are no longer interested in the position.

Sure. Here's mine--the same as yours except for that sentence:
"This email is to provide you with an update about EOIR’s hiring for the 2010-2012 clerkship year. Because EOIR is still waiting for budget news, we do not have any further developments to share with you at this time. However, we want to let you know that you remain under consideration for one of the budget-contingent positions, provided that the position is funded in the FY2010 budget. As with all positions, we do our best to match the specific location with your identified geographic preferences. We will be in touch when we have more information."
I feel like the difference between the two E-mails could go one of two ways (either I probably have a budget-contingent offer and you're just an alternate, or "alternates" are people who'd be under consideration even without the budget going through and I'm only still in the pool because the budget might open up a position for me somewhere down the line)--I'm obviously hoping the former is right, but I don't have any idea how this process is working.

Alright, what I found out is that my friend received an email saying that s/he is still "under consideration as an alternate for one of the budget-contingent positions..."
So, according to what we have posted here, there are now three different versions of this email--giving three different designations. This has lead me to do a lot of rapid thinking.
What do we know so far?... We received an email on or about Nov. 18 telling us that the first round of offers had gone out and that the second round would not be made until after the budget was passed. Then we receive another email yesterday, Dec. 16, as an update and designating us as one of three different categories (presumably before the EOIR knew that the budget had been signed), these cateogeries consisting of alternate, position contigent upon funding, and alternate for position contingent upon funding.
Now, My guess is that the first round offer recipients were given a maximum of one month to accept the offer. Then this would mean that at least some of those did not accept the offer. If they had, then there would be no need of such a designation as alternate (withouth the contingency factor). Further, it appears that the email, sent before the budget was known to have passed, was probably sent because they had just made the designation following the completion of the first round of acceptances. So, the question then would be, do they still have more alternates then non-budget contingent positions? My best guess and hope is that they do not. I would assume that they will make the second round of offers for the remaining non-budget contingent positions and the first round of budget contingent positions all at the same time. This would mean that they would have the exact number of non-contingent alternates and first rounders who were contingent on the budget that they need. Then of those that don't accept, they would move on to the alternates who were contingent upon funding.
I apologize for the long explanation (for those of you who were interested enought to read), but this is my best guess and I really hope this is the case. The one fact that doesn't make a lot of sense to me is that at least three of us posting on here were designated as alternates without the budget contingent language, and collectively we only know of two others each with a different designation. I would assume that there couldn't have been more than 4-5 positions that were not accepted in the first round. Perhaps it could be that nearly all of us "alternates" are posting on here--purely coincidental.
Anyway, I'd like to hear what other guesses are out there--until things are settled (and who knows when that will be?).
