yes there is. that's what a "2(f)" claim is for. this particular app has been chapping my ass for months, about to do a 2(f) claim for it. Its descriptive as fuck, but was registered for 7 years, and been used in commerce for over 10 years. Also, the client will go ballistic if we mess this one up.

Eh, file the application, and if they require documentation/evidence to support secondary meaning then gather up all you've got and see if the client is willing to pay for some sort of survey or something.
