this morning:

This Court has also stated that “adjudication of the constitutionality of congressionalenactments has generally been thought beyond the jurisdiction of administrative agencies.” Thunder Basin, 510 U. S., at 215 (internal quotation marks and brackets omitted).

We need not, and do not, decide whether the MSPB’s view of its power is correct, or whether the oft-statedprinciple that agencies cannot declare a statute unconstitutional is truly a matter of jurisdiction. See ibid. (describing this rule as “not mandatory”). In Thunder Basin, we held that Congress’ intent to preclude district court jurisdiction was fairly discernible in the statutory scheme“[e]ven if ” the administrative body could not decide the constitutionality of a federal law. Ibid. That issue, we reasoned, could be “meaningfully addressed in the Court of Appeals” that Congress had authorized to conduct judicial review. Ibid.

I don't much care for the bluebook, but as a lawyer who's accustomed to seeing id., not ibid. in legal documents, I found this confusing.

The Supreme Court has long used different rules than the Bluebook, including use of 'ibid.' Google and ye shall find.

yeah, in ginsburg's opinion in wood v. milyard this term, she weirdly switches between id. when citing different page numbers, and ibid. when she's citing the same page as she did previously

That's proper under their rules. I think it's more intuitive than the Bluebook rule, and I would be quite happy if the SCOTUS rules superseded all the Bluebook rules. Particularly, I don't like italicizing non-Latin signals like 'see.'

well all I can say is that at my coa, the clerk does not bluebook, at most they format opinions (and do a shit-ton of other stuff, mostly stuff involving the parties and their submissions to the court)
