Is it CR to write "This issue here is . . . " for every issue?

Bar review class told us to do it. None of the essays on baressays.com do it, even the high scoring ones (although they're all essays from people who fail, so...).

whats the general consensus?

i have the same Q, breh. I write "The issue is ..." every once in a while, but not for every block.

No, that is stupid. Just use heading. If the issue is willfulness, just have an underlined heading called "Intent," and then jump into "The elements of intent are . . . "

Bar review classes give you a failsafe retard level system for people who just can't figure out how to structure an answer. If you can clearly and concisely communicate the point to the grader, you don't need to follow their "system." They reward clean, competent writing, not following the bar review course method.

How much do they reward clean, competent writing? substantively, all the fucking essays from 55s to 70s look similar on baressays.com; havent really looked into quality of writing though.

They reward it a lot. Part of what you're trying to do is not alert the bored, tired bar grader that you're somehow dumber than the last guy. Make yourself easy to follow, hit the blackletter as much as you can, but don't go apeshit with structuring and mechanically repeating whatever structure the course suggested. There are retards who will follow the course advice to a T and still write shit essays that read like legal madlibs. You probably know how to clearly and concisely express yourself after three years of law school, so just do that and don't worry about the bar course. Like I said, they're providing a parachute for the bottom quarter Chapman law grad who still thinks "alot" is a word.

you could but i don't think you have to and it sounds dumb

just do heading/sub-heading, rule statement, and then application. your application should just be: "Here, ...."

Tip - just do it for consistency. The grader will not care or pay attention if you have it in there, but if the essay looks sloppy, inconsistent or hard to follow you will get ding-febbared

Nothing wrong with "The first issue is whether...", etc. But if you're using headings for every issue, which seems excessive to me, there's no need to repeat yourself.

planned on doing this but took too much time to right a good issue statement. Just did headings. Hope Barbri was wrong about this...similar to how they were wrong about the MBE

thats great to hear. i changed it after the 1st essay because I was running out of time. My Heading weren't that special though. Doubt I get dinged for overbroad headings tho. The wait is gonna be the worst.

feel like I prob failed the bar. My headings didn't really state the issues properly. Time Pressure got to me and I prob lost an easy .5 point on every issue I spotted.

Negligence vs. Guy

P will likely bring a negligence claim. <Rule>

Procedural Due Process Violation

These won't get it done. Guess I'll be back at it in Feb.
