In March 2007, pseudonymous poster “Patrick Zeke” sent an email to the Yale Law School Faculty with the subject heading: “Yale Law Faculty concerning pending lawsuit.” The author of the email made false and harmful comments about DOE I, including: “[DOE I] is barely capable of reading (159 LSAT),” and “it seems like the risk of contracting herpes from [DOE I] would convince any rational person to go to a prostitute first.” This defamatory email was then posted as a thread on the AutoAdmit site by pseudonymous poster “lonelyvirgin” with the thread title “new lonelyvirgin e-mail to YLS faculty.” |

* delete past and prospective threads on Autoadmit about the plaintiffs; * de-index the plaintiffs from Google and other search engines; * require Autoadmit to log IP addresses; * require Autoadmit to create a term of service agreement and a complaint response system.
In return, plaintiffs would dismiss Ciolli, and (I take it) proceed against the pseudonymous defendants alone. |

Keker & Van Nest has apparently staffed this case with no less than 5 lawyers, including one partner, one of counsel, and three associates. Plus Professor Rosen. That makes no sense to me whatsoever. Do these lawyers have nothing better to do with their time? The evidence seems to suggest: No they don't.

They probably are all excited about litigating a cyber-free-speech case. You add cyber- in front of anything and it's hot for academic types. Cyber- and 1st Amendment--that's like WHOA. Personally, I think the case is retarded, but whatever floats your boat. Maybe KVN will get to advertise that they have won a pro bono verdict against "cyber-bullying" on their website, and their names will be recorded in "cyberlaw" textbooks.
Meanwhile, non-privileged, non-Yale-law-student, ordinary or less-than-ordinary folks with real problems throughout the country lack pro bono support. |
