XO may have already covered this. This dood bought a Ferrari under some sort of tax haven shell corp in Montana and never paid the sales tax to Williamson County.

His complaint is that they never sent him a letter saying it was owed. He also complains that he pays a lot of taxes already so this surcharge is ridiculous. The car was also destroyed in Texas somehow. But it's heavily implied that the car did spend considerable time in Tennessee.

He's also 'in the process' of purchasing property in Montana and therefore should be exempted. Also mentions having a Russian fiancée who lives in Dubai wtf.

This is all so crazy but it seems like he almost certainly bought a $400,000 car in Montana, drove it to Tennessee, and owes $30k in taxes. Instead of sending him a letter they just arrested him. Sounds like he's guilty and just pissed that his tax avoidance scheme didn't pan out.

Use taxes and vehicle registration can be related, but they don't have to be. You can register (and pay) in one place and you (or another individual or entity) can be responsible elsewhere under laws concerning use and possession.

It seems like he's bought dozens of luxury cars and blown them up in different ways in this manner. He buys them in different states and destroys them in different states. And then he sells the remains of the destroyed vehicle to his fans. Dude is just going around spending millions of vehicles and never paying tax on any of it. You would think he would just write it off as a business expense no? But I read that the actual business of YouTube videos of luxury cars being destroyed, and even the sale of the parts doesn't recoup the losses on the cars. Apparently he makes his real money with brand deals for alcohol and he actually promotes Sweet Baby James shitlaw. So the cars are a business loss for him but he's net positive on the brand deals. I don't get why he can't write off the cars as a business expense.

It might be hard for Tennessee to prove that the car was ever in Tennessee unless it's in a video there. Here's an interesting example. During COVID remote workers in Boston were told to stay home. So New Hampshire residents didn't claim any Massachusetts income tax. Mass tried to come after them but they claimed that because they live and work physically in NH they don't owe MA any money just because they used to work there before. Anyway the tax evaders won in court and didn't have to pay. Will be interesting to see if Tennessee argues that a dude who owns a car in another state has to pay the tax just because he's a resident half the year or whatever.

deducting something as a cost for income purposes doesn't change the tax you pay to acquire, register, etc. it. i'm sure he does write it off as a business expense, but that's a different tax.

in your example the people weren't in MA. he is in TN. proving that is unlikely to be an impediment. ime the tax man doesn't come this heavy unless it's a slam dunk.

they have license plate readers set up all over this country now and the cops try not to mention it because it is creepy as fuck but they can easily prove you were on the road if you ever go through intersections in america

The biggest issue I have heard of with registering your car out-of-state is that supposedly your insurance company can deny a claim if you are the at-fault driver, by saying you were not compliant with the "laws" and that voids any claim you have against them. Lawyers with YouTube channels who discuss the issue basically settle on this as the ultimate reason to advise against it, I just can't square why an insurance company would get to hold your compliance with laws of registration against you (assuming you accurately tell them where you actually drive and house the vehicle, that would be an entirely separate issue).

plus the market for insuring HNW supercar owners has to be very lucrative. they've got access to their driving records, these guys aren't likely to wrap their car around a tree, but they are expecting to pay a huge insurance premium regardless. every time i see a supercar it's being driven very carefully with the driver's hands clenched at 10 and 2. denying claims for that out of state registration (insurance company knows where it's registered and where the insured is domiciled + insured probably has one of those tracker apps) seems like it's bad for business in the long run as richmos will switch carriers if coverage is getting denied for a tax avoidance scheme they're all doing. esp against a sophisticated insured that will likely contest coverage denial.

that being said i've seen insurance companies do extremely retarded things so nothing suprises me.

you still do hear about insurance denying coverage for stuff like this. but yeah there's gotta be a way for a legit llc owner with a car that spends times in multiple states to get appropriate insurance. commercial insurance is generally more expensive than personal though, and so a bunch of car owners who are trying to do the supercar llc loophole thing may cut corners
