it's a tough call. I think the Court's probably divided a few ways on this: no standing, standing because there is injury in fact, standing because congress presumed there was. of course, once congress can presume that there's injury in certain situations and create standing where there otherwise wouldn't be, that opens a huge can of worms and I think that's what they're taking so long over. other than first american financial, we're going to get even more confrontation rights in williams, possibly as early as tomorrow, life without possibility of parole for juveniles is probably coming out this week or next, in southern union the court decides the exciting question of whether apprendi applies to fines, the fcc's network tv censorship regime is up for invalidation in fcc v. fox, and we'll soon learn whether we have a first amendment right to lie in alvarez. there's also a fun little case about whether pharmaceutical sales reps are salesmen. and then there's healthcare and arizona immigration law

i went to argument, hard to call it. the three conservatives who talk were all for the government. Kennedy was more blatantly on alvarez's side than anyone, closely followed by breyer and rbg. Kagan seemed to be on the fence.
