the key to cold calling in 1L is too NOT FREAK OUT ABOUT IT. as a matter of fact, dont wholesale bail on it, but there were many who, because of fear of being called on, overprepped. like don't get too deep into the cases, let the gunners "help you out", because--trust me--they will. keep with the commercial outlines. black letter law. going over old exams. sharpening that IRAC. and you're good. cold calling is a game of knowing the facts from commercial briefs.

And common sense tells you that such a rule would be a computational clusterfuck. Suppose the principal is $100k and $70k interest has accrued. I make a $1000 IBR payment. Am I paying down the principal? The interest? Or am I paying down both pro rata? If pro rata, do I need to keep records each time I make a payment to figure out how much to deduct from the principal and how much to deduct from the accrued interest -- keeping in mind that each deduction from the principal or interest changes the pro rata proportion, as does each time interest is compounded.
The easier solution is not to distinguish between principal and interest -- debt discharge is debt discharge, and it's all income. |

Say I have 200k in loans making 60-100k a year, and I cop dat IBR. Then in 10 years I start my own shitlaw firm or make partner at some moderately successfull shitlaw firm and am bringing in 200-300k a year and no longer qualify for IBR... Am I now completely fucked paying all the interest that my loans accrued while on IBR or is it still forgiven after 25 years?
For my current situation this is the most likely scenario... 65-100k for first 5-10 yrs, then 200k after that with more available... Should I be copping that IBR for the tiem being or will i be debt pwned after if I no longer qualify? If so is it worth possibly deferring income to remain just under the IBR threshold and then get a windfall of income when money is forgiven? |

Anyway, if you volunteer 1-2 times per class (when you know the answer or feel ok guessing) you will virtually never be cold called. |

if you know you are being called on read the case a couple of times. if the prof doesn't tell you in advance, just try to bullshit as best you can. keep focused on the big picture and learn the law through the commercial outlines and supplements. they have so many people in the class that they won't call on you twice a semester, so at the most you look like a jackass for 10-15 minutes. |
