I've seen it happen twice. Both times, the associate was given another chance and passed the second time around. I'm pretty sure the second dude got docked pretty hard (like 50% salary/no bonus until he passed). They also changed his job title to something like "legal clerk".

The girl didn't get her pay docked - she was a "legit" hire and everyone really liked her. The guy (two years later) did not get hired through the OCI/summer associate program. His father's company was a major client in transactional, lit and IP. He was a nice enough dude but obviously did not belong in biglaw. He had mediocre grades from a middle of the road state school and had no work experience and nothing else impressive on his resume. I was told that his father made a pretty strong request/demand that the firm hire his son. Some partners were for it, some partners were against it. When he failed the bar, there was egg on several faces. The managing partner came down pretty hard on him- docked pay, etc. I don't think that's the normal practice, though.

Yes, for sure, but happens more frequently with laterals. It's a good proxy for determining laziness, as that's the only excuse for reasonably smart people other than extraordinary circumstances.

I haven't seen pay get docked, but everyone got a second chance (and one person didn't pass the second time either and he got the boot the day of the results).

Once in a while, you'll see people who fail the bar. They usually pass on the second chance, but they normally do not make it into their third year with the firm. The stigma is just too substantial. While the other kids are working, you're fucking studying for the bar.

In ca it's very common for some to fail. If biglaw firm has twenty plus first years there's always one to two who fail, and it's not jut blacks u dumb fucks, lots of ppl suck at tests like that or freak out On Test day or just don't study the right way

I think he was worried about failing. I went to school with him. I suspect he did poorly in school. He ended up at a midlaw like firm in NY out of OCI. So I think he kept on delaying the inevitable failure. I don't know if they lowered his pay or anything like that. I would think so.
