Labor. I'm new so I'm pretty light. I just got done marathon writing a brief do was very busy but today don't have a lot. I'm not going to ask for work. Learned my lesson about that in midlaw. From what I can tell, people get here between 8-9 and work till 7 or so and hole up in their offices. Very different from my midlaw firm where we'd all go out for lunch and bullshit around here and there during the day.

There's one partner in my group who seems to be here till like 10 most nights. Fuck that.

Midlaw firm tops out nonequities at 250k and it's super hard to make equity so realistically I was capped at 250. I'm making 240 walking in the door here. I was making 180 as a senior associate there, might hVe gotten a bump to 200 with the promotion.

Not sure how you make partner man. I don't think it's focused on business generation up front for the very reason you said. No 30 something senior associate is bringing in biglaw caliber clients. Honestly I'd be cool with of counsel making 300 something.

Also I can go back to my midlaw firm anytime. Or do gov after banking money for a while.

Right now I need money. New babbydood and would like to have another. With one kid in the DC area I was feeling strained on a hhi of around 270k. So I have to earn money for the next 5 years or so.

Also I billed around 2100 in midlaw. I think the whole midlaw is chill thing is somewhat untrue. Though we had people who billed like 1700 a year.

By strained though I mean that wife and I were both maxing out 401ks, I was saving 11k in Roth accounts for us, $1300/mo in taxable stock accounts, $700/mo in cash and $1000/mo in a 529. So it's kind of bullshit for me to say we were actually stretched. I guess it's just greed. So I get to add around $2500/mo to my taxable investments now.

I've only done one or two of those ever, because I'm a traditional labor bro. But I've written tons of post trial briefs and appeal briefs to the NLRB and it's a similar process. Depends on the case. Some are very law heavy and you do like 25+ hours of research. Others are really straightforward legal issues and all about da facts.

This is quite the subthread wasteland.

The NLRB judges, first off, work for the NLRB but are supposedly neutral because they're in a different division from the General Counsel (prosecutors). Of course, roughly 99% of these judges are lifers who spent the first 15-20 years of their careers trying cases for the NLRB. They're biased. Then you get to appeal to the full NLRB in DC. That should really give an employer comfort. However, NLRB decisions are reviewable by federal circuits so there's that.

The NLRB has its own precedent but when you get an activist NLRB like we have now, they tend to overturn prior rules. The COAs can refuse to enforce an NLRB order but that never changes what the NLRB does - it goes by its own precedent. The scotus is different - those cases obviously are binding on the NLRB

In actuality the NLRB is very political. When you have a liberal board they bend over backwards to find for unions and employees. When a conservative board, vice versa

It is a huge hassle, but it's good training. You have to craft winning arguments to get the docs you want from the other side. You build up confidence arguing at meet-and-confers and shit. It can also be a very effective device to get your client what it wants - I've been on cases that settled over discovery shenanigans.

9:10am - get to work

9:20 am - read email memo I asked jr associate get me by last night

9:21 am - palm face

9:45 am - send comments to jr associate

10:00 am - client call with partner

10:45 am - make jr associate research stupid case that partner is convinced exists but I know does not

11:00 am - work on drafting motion

12:00 pm - redo parts of research I asked jr associate to do for memo but that were fucked up

1:00 pm - get lunch, eat at desk

1:20 pm - flip deposition preparation binder full of docs client is on

2:00 pm - revise witness outline for deposition prep

3:30 pm - email paralegal and jr associate asking why relevant documents aren't in the binder

4:00 pm - receive bullshit letter from opposing counsel complaining about something

5:00 pm - meeting with partner re: bullshit letter

5:15 pm - listen to partner rattle of stuff that should be in response letter

5:45 pm - start drafting response letter

6:00 pm - receive corrected binder that should have all the documents I need for deposition prep, but that I now have to QC because I can't trust jr associate and paralegal

7:30 pm - dinner

8:15 pm - send partner draft of response letter

8:20 pm - back to working on motion

9:15 pm - car home, motion still not done, but fuck it I want to watch TV and have a beer

10:00 pm - email from partner - good draft, let's discuss tomorrow, see if jr associate can find some cases saying what they are asking for is bullshit

10:01 pm - forward email to jr associate saying let's talk tomorrow morning

10:05 pm - get response from jr associate saying some bullshit about having an appointment tomorrow morning and assume she is interviewing at other firms, think to myself good riddance

Also seems very desperate to get into legal academia. I guess she has a shot at becoming a prof. at a T-20 school, but her research seems scattershot. I guess she is interested in property? IP? Hard to sell her as an expert on any particular area and though I have no idea I suspect becoming a property professor is tough as schools want to woo stars in areas students actually care about like constitutional law.

It is annoying as shit, though I spend about 45 minutes a week on it. Yes, we have to account for every six minutes of our time, which is actually .1 (not .6). You get used to it and there are phrasings that you use to make it so that you only need to write a few lines per day of entries. (Like "attention to thread with S. Shadyman; internal emails re: same; drafted/revised response to S. Shadyman")

Hard to say how you get the keys to the castle. The most important characteristics are being responsible, self-starting, and being loyal to the rain makers. (You have to be someone the senior partners trust to run their cases on a day to day basis and who important institutional clients seem to like.) In biglaw litigation, it is difficult to get repeat business because we often are litigating one-time, "bet the company" type things. So there is really no expectation for associates to bring in new business. Corporate is different.

Biggest challenge - balancing work/life and saying no to stuff you want to do to not make yourself crazy busy. Also challenging is remaining calm when you are doing terrible, mundane shit like changing a brief back to the way you originally wrote it because the partner changed his mind on things. Example: I recently wrote a 70 page document that I organized in what I thought was the best and most logical way. Partner disagreed and I spent 10 hours on a weekend when I was traveling out of town fixing it. Sent it Sunday night at 11 pm. Monday morning at 10 am he asked to go back to the way it was. Just had to grin and bear it because of who this guy was.

In any event, I'll bite. A MTD usually takes us 30 days. Typically, there will be 1 round of junior partner comments, 2 rounds of senior partner comments, then client comments, then final comments from the partner. So really I have about 2 weeks to put together the motion before the junior partner takes alook, which--in a big securities fraud case--is around 50 pages. A summary judgment motion should take about 6 weeks, but we typically have to do them in 30 days and the review schedule is similar, but the worst part is doing the facts/56.1 statement and rounding up all the stupid evidence you need for that, which includes both documents and deposition testimony. Reply briefs are also bad because we typically only have 2 weeks and we can't prepare in advance that much. Those, I usually have to write in a week.

I am curious though about why the client would want to even review something as technical as a SD motion (probably the statement of facts is an exception) since they probably wouldn't even know all the jargon and caselaw discussion going on.

Staff attorneys review documents. I write briefs, meet with clients, etc. It is a world of difference. The most substantive task I'd let a staff attorney do is gin up a first draft of responses/objections to document requests or RFAs. They don't get to do shit except possibly manage contract attorneys and coordinate me responding to their annoying as shit questions.

I like what I do and the money is good. Hours don't bother me at all. What bothers me is bitching from my wife who works less than I do and who complains when I'm not home until 9 as if that is late. Trying to get into a routine where I get to office by 7:30 and leave at 7 but that is tough given the nature of being a senior associate and the fact that it's winter and dark in the morning now.

It absolutely flies by for me. There are not enough hours in the day. I wish days were 36 hours long so I could get all the shit I need to get done and leave and go to the events I really want to go to. Most cases are sr. partner, jr. partner or sr. associate, and then midlevel or junior associate. Due to the recession and deferred hiring etc. there were not a lot of juniors for a while so now having a first year on a real case (and not just doing doc review or one-off research assignments) is pretty uncommon.

Poasting in an historic thread where I have drawn SSM out to a promised last question in a subthread wasteland!

I already provided the breakdown of a typical day. In a given day of 9-10 billable hours, I probably spend 7-8 hours doing real research or drafting/revising memos, briefs, or substantive emails. The rest of the time is usually meetings and calls with partners/associates, reading stuff (including looking at discovery), client-related stuff, firm related stuff, mentoring/providing feedback to jr associates, etc. It varies a lot by the day. When we are in the throes of discovery, I can spend 7 hours preparing a deponent and then have another 7 hours of shit to do when I get back to my desk at 4:30 p.m., which blows. On the other hand, there were weeks in August where I did nothing but work on a brief without interruption.

BTW in-person client meetings are not flame and almost always entail a bunch of bullshit running around the night before making sure that binders, handouts, and other shit is prepared and has been checked for quality. Also, for telephonic meetings, some partners will ask for bullets/agendas beforehand which is very tedious.
