I think the private college should be able to make up these rules and fuck themselves in the end, but they should have to give $ back to the student. The contract they entered into with the student had a certain degree of reasonableness with respect to their disciplinary policies.

If I had a son, I would steer him to my state's public university. |

The English language is precise but it would take an inordinate amount of verbiage to articulate every single little random shit that could happen, and having a no exception 4-corners rule would increase transaction costs to an inordinate degree.
Written broadly, the regs literally gives colleges the power to expel a student for spitting on the sidewalk, b/c parties understand that it's more efficient to draft the contract to give them broad discretion b/c there's just too many scenarios to address in any contract, but there's also an implicit promise tat the college won't go crazy with it.
Here, both parties (the college and the student) knew that in essence the rule is for students to conduct themselves well and for disciplinary actions to fit the behavior. This is the equivalent of expelling the student for spitting on the side walk. |
