I've been following Cali for a few years and I've always thought about going solo. I have been practicing seven years (2 private practice at mid sized firm and 5 as County attorney). In my current county attorney position I do a little bit of everything but mostly civil rights defense for jail and sheriff. I make 100k and will top out at 120k in a few years until my boss leaves in about 10 years (he makes 140k). Great benefits with pension. Easy job and only have about 20 hours a week of actual work so I'm bored as shit. I have no flexibility in my schedule so I sit at my desk with my thumb up my ass pretending to work a lot. My wife also makes 100k in a low cost of living area so I have enough money. I have good connections to area and have always been interested in going solo. Am I batshit crazy or what?

I could set up my practice but it's a small community so everyone would know. Not to mention I can't by statute in my state perform any private work while I am employed by government.

You don't have to perform work, but yeah, set it up. Create a website, start networking with local bar, pick a practice area and/or otherwise refine your lawyering. There's really no conflict until there's paid work.

It's hard to leave an easy gig like yours, and I wouldn't do it unless I could absolutely minimize the downside risk of the opportunity.
