how can an executive order just flat-out contravene a bunch of existing federal immigration laws?

basic separation of powers, bro

congress makes laws

president executes them, meaning he can elect how and when to execute them

congress's remedy for this is impeachment

but seriously, it seems unlawful. and if that's the case, then it is "repealed" automatically, since it would be a legally-invalid order.

i always thought detrimental reliance was the "strongest" public policy-type argument to be made. there really needed to be a legal challenge right when it happened.

that's not how reliance would even work, though. it would be converted into something like a "taking" with demands for money compensation. the fact that people relied on an illegal law does not make the law lawful. cops can't "rely" on 4th amendment violations or something and then make those violations legal because they came to rely on their illegal methods.

The executive can exercise prosecutorial discretion.

But what do you want, judges to order the Feds to prosecute? So the judicial branch is now mandating prosecutions and hearing the case?

Charging an application fee in exchange for prosecutorial discretion is called bribery

Also there's no prosecutorial discretion if the Hawaii judges won't let the prosecutors choose 1 out of their 2 options

I personally think the courts should stay out of it either way--executive function that can change without judicial review including after an election.

It likely wasn’t. Janet Napolitano was allegedly not convinced that President Obama had the authority to do it.
