this is what's giving me the most trouble on the practice Qs: choosing what the company says is true, but "incomplete." i'm usually 50/50 between the right and wrong answer, but sometimes go with the wrong "incomplete" choice.

are real bar questions ever wrong because incomplete? or are there 3 truly wrong and 1 truly correct?

can't think of any right now.

but basically:

A) Obviously incorrect

B) Very likely incorrect

C) Could be right, seems right, but would require a leap / an assumption

D) Correct statement of law relevant to the problem

We're told C is correct

Lol you're going to need a real example.

But there is always a flaw in three of the answers. One is clearly better than the others.

i've noticed that we're told some answer choices are incorrect because they're "incomplete," and therefore, "not the best answer," in contrast with a choice that may be more complete (but also required a leap of faith / an assumption to draw the conclusion)

You doing Kaplan? A lot of the Kaplan, Barbri, etc. questions have misstated law. Even some of the videos and outlines have obvious errors.

Some of the barbri questions are worded poorly and some try to trick you with ambiguity instead of a hard nuance like the real questions. I suggest doing some real questions before you go in there. I think there's a torrent with real questions.

what's the difference between hard nuance and ambiguity?

one of the type of Qs I hate are ones that ask, e.g., "if a jury finds Defendant liable, it is most likely because the court applied the

A) Modern approach

B) Common law

C) English Rule

D) American Rule"

C and D could be ruled out because not related to the subject matter, but fuck if I know the difference between a modern approach and common law in some niche area

Barbri tries to hide the ball on some questions to make them harder and you'll end up with a maybe between two answers depending on how you read the fact pattern, and the explanation will be like "this obviously meant the one way so B is correct." The real ones will have some exception to an exception that gets triggered by some detail buried in a bunch of other shit that looks like it's testing something else, but if you know the law on it really well you'll have an obvious answer choice

On the MBE, some questions are dumb, and some test prep practice questions are really off. Not sure what company you're using, but I know that some show the breakdown of questions missed - so if you read their explanation and still think the answer is A, and see 50% of people also thought the answer was A, then you're probably okay as long as you understand why minimum wage test prep writer thought it was B.

On the essays, I saw at least one practice essay for my state that was just blatantly incorrect. It was in my practice area and the model answers completely mis-analyzed the issues IMO. I'd be interested to see if real graders would have given my (correct) answer a passing score, but my practice test grader did not..

Subject: OK, here's a good example of a SPS question:

https://imgur.com/a/XjuNn

A: Deny the motion, because no search occurred.

B: Deny the motion, because fingerprinting is standard booking procedure and no warrant is necessary.

C: Grant the motion, because the defendant did not consent.

D: Grant the motion, if the defendant objected at the time the prints were taken.

A

"Fingerprinting involves none of the probing into an individual's private life and thoughts that marks an interrogation or search." See Davis v. Mississippi, 394 U.S. 721, 727 (1969).

yes, A is correct, but only 23% of respondents picked it. 73% picked B.

B is also *correct* but just less responsive to the prompt, although the whole thing is made confusing because the prompt says seizure and A only refers to a search
