Date: April 25th, 2018 3:32 PM Author: Vibrant dysfunction the State should not think of itself as an adversary of the People under any circumstance, pitting a rabid 'prosecution' against helpless individual citizens. that is an insane approach. the goal in the adversarial system is for the state to 'Win', for its representatives to invest themselves in 'Winning' and in building professional esteem/careers as 'Winners'. this creates MANY perverse incentives/consequences. the goal should be for the state to seek a rational outcome from the get-go. to be restrained -- not to 'Win.' no agent of the state should be referred to as a 'prosecutor.' it sets the wrong tone entirely. |
