2) people say this is a continuation of obama policies. is there a specific statute / EO that obama passed on this?

In the old days they just locked up the families together in detention indefinitely until they could get processed and deported.
Then in 1997 the DEMOCRATS adopted the Flores consent decree which did not allow kids to be kept in detention more than 20 days.
The result of this is that kids had to be let out and the practical effect was that any adult sneaking in with their children were let out as well pending their trial in a couple of months. it created a perverse and dangerous incentive for illegal immigrants to bring children (who may or may not be theirs) which allowed then to avoid permanent detention while awaiting deportation. This is the "catch and release" people are talking about. The parents were supposed to come back for their court date but they never do.
Previously adults sneaking in were usually not subjected to criminal trials which could result in their conviction and accelerated deportation. The zero tolerance policy means that all adults are prosecuted when sneaking across the border. Obviously you cannot put little kids in a real jail with rapists and shit.
So there is the issue of taking the kids away when the parents go to jail. They plea guilty and end up in detention pending deportation - or they ask for asylum and end up in detention pending that outcome. Either way kids cannot stay in DHS detention for more than 20 days so something else needs to be done with them, if we are not allowing the whole family out. So they are transferred to HHS and shipped to relatives or put in foster systems, etc. Reuniting them with their deported parents may prove logistically difficult.

they are put in the unaccompanied minors group home while they look for relatives. I am not sure if they are temporarily fostered by strangers.
What is weird is that the kids are transferred to HHS because of Flores while the parents remain subject to DHS. The parents could be convicted and deported and the kids might take a while to be reunited then.
This does need to be fixed and the easiest way is to send them back to fucking Mexico together, or lock them up together and then send them back.
