I can't recall the case now, but I swear one of the S. Ct. cases that went against the Bush administration's war on terror ultimately had its reasoning based on Korematsu - something like Korematsu articulated a legal standard, which was met with Japanese interment, but was not met with regard to Guantanamo or something like that

Are these cases based on Korematsu now bad law?
