You'll recall my dad got a ticket for causing a crash a couple months ago. Well, the court date is next week. I had told him I would help him, but honestly, the only way he's getting off is if the other driver doesn't show up to court and he properly shuts down any hearsay from the officer and then makes a motion to strike. The physical evidence does not bode well, however, and he'd probably still need to testify in his case in chief. And that will be a cluster.
Anyway, dad asked me to research how many times the other driver involved in the crash--the one who did NOT get a ticket--had been in prior accidents.
I explained that this is not admissible and is irrelevant. He disagreed w me, asked me to do it anyway. I told him that even bringing that up when it is clearly inadmissible and irrelevant is only going to be perceived by the judge as being mean-spirited, and that he should leave it alone. He opted to disagree w me. This cannot end well.
I then told him he should just represent himself in court as I have something to do that day anyway. He said fine.

lol. No, its just an improper lane change ticket.
I told him to plead not guilty so its not a total gimme if she comes back and sues him later for personal injuries--Guilty pleas are admissible civilly in my jurisdiction.
If he's convicted of the traffic offense after he pleads not guilty to it, that conviction is not admissible in a subsequent civil trial.
He might get thumped a bit by the traffic court judge for pleading not guilty instead of guilty if he loses (they don't like to have their time wasted) but that's better than going into any subsequent civil proceeding w an admission of negligence right out of the gate.
He says none of that matters because "she wasn't hurt". Lol, okay dad.
