Just popped 100K policy on $500 in PD (CSLG)

Adjuster offered $40,000 prelit. Then I filed and served a 998 (statutory offer to settle) for $100,000 along with the following letter. I got a call today offering the 100K policy in exchange for a release instead of a judgment.
"My name is [REDACTED] and I represent [REDACTED] against you for the accident of [REDACTED]. Below are the current medical expenses for our client, [REDACTED]:
[REDACTED]
We have presented all of these bills and reports to your insurance carrier, [REDACTED]. On July 19, 2018, we sent a demand to [REDACTED] for your policy limits of $100,000. We were willing to accept your insurance policy limits and NOT to go after your personal assets or for contribution. Given the size of our client’s medical expenses, we thought this was a fair and more than reasonable offer.
We always prefer to avoid going after Defendants personally. [REDACTED] has rejected our efforts to settle and only offered $40,000 (only a quarter of our client’s past and future medical expenses).
Included with this lawsuit is a statutory offer to settle for $100,000. Once this offer expires, we will no longer accept your insurance policy limits and will seek personal contribution from you. Our next demand after this offer expires will be significantly higher. We hope that [REDACTED] becomes reasonable, so we can settle this case quickly and without any inconvenience to you."

Hitting more than limits in trial is proof that it was reasonable the claim was above limits.
That bad faith claim can then be assigned by the defendant to plaintiffs to collect the excess judgment. |

the insurance companies have more money resources to deal with these litigations than any plaintiff lawyer.
these insurance companies would never pay a penny if an injury claim is made 1 hour after the statute of limitations ran.
the only reason they pay ANYTHING is to protect themselves.
