This has mainly been used to invent new rights and expand the scope and power of the federal gov over americans. If this weren’t the case then maybe scotus justices would be approved easier. But this is the reality and presidents don’t get the 98-0 deference that was shown to Ginsburg anymore.
Obama could have nominated an actual centrist or a conservative and had them approved. He was not going to because he is a liberal. Senate advised him that Garland was not acceptable. Tough luck. I guess win the senate next time or nominate a centrist. |
