Jurisdictional rules can greatly affect your strategy but generally, but if you’re looking for a deal, under these circumstances, you might be better off trying to take it out of the state’s hands and dealing directly with the court. Again, depending on where you practice the nuts and bolts of making this happen can vary greatly, and obviously, it all depends on your read of the judge and ability to get a decent outcome from the bench. Option two is trial. You and this dickhead don’t have shit else to talk about, and your best bet is to be as aggressive as reasonably possible in hopes of either forcing the state’s hand or bending the offer toward something more palatable |

Date: October 18th, 2018 3:51 PM Author: At-the-ready cream school cafeteria gaping in one case in particular, the Defendant is more than willing to plead to one of the two charges, but refuses to plead to the other charge because it'd fuck with his job / job search. i relay this much to the state, who provisionally agreed to drop the second charge. next thing i know, the case is in someone else's hands and both charges are back on the table. now state is threatening to up file if he goes to trial or doesn't take plea on both charges at next court date.
if the terms were what i was worried about, yeah I'd definitely plead open |

Those are my favorite prosecutors, obviously. I went into a misdemeanor VOP hearing ready to offer 120 days suspended for a DUI client who violated probation, fled the state, got a DUI in that other state and got arrested on the plane on their flight down here for being too drunk. But you can’t be weak here. You already aren’t getting what you want. Don’t be afraid of trial either. The one thing a prosecutor never wants to do is having to explain an NG or a lesser to their higher ups or to their witnesses. The reason half these dickheads play tough like this is to dissuade you from taking it to a jury in the first place. Take this guy to the brink |

I brought him in, convinced angry WOC judge that he would finish the classes and she was cool with giving him 30 more days. ASA tool insisted on imposing the downside ("THIS IS A CONTRACT BETWEEN THE DEFENDANT AND THE STATE!!") and my bro was taken into handicuffs on the spot. |
