Since 2014, my dog has got more misconduct charges than I have ("my dog"), has organized the Mega Poster Madness tournament ("MPM") on Autoadmit.com. Although posters completely disregard a poster's actual content and instead simply vote for their friends, MPM has provided the winner and finalists poster capital and certain other bragging rights. Many participants view advancing beyond the first rounds as critical to reputation. The 2018 tournament, in particular, is currently being conducted before the largest audience to date. See threads re FBI monitoring the board.

Though posters nominate each other for several reasons, including out of spite, they do so under the impression that the tournament will be conducted in a fair and impartial manner. This impartial process includes: one poster, one vote; pseudo voting only; and of course, an accurate tally of the votes.

In a highly anticipated contest, lawman8, seeded 3, matched up against colt (aka "cort"), seeded, shockingly, 30. After round 3 voting closed, my dog determined that colt edged lawman8 by a single vote. Yet he failed--or refused--to notice that at least one poster, melania, voted for colt twice.

lawman8 thereafter brought the double-voting error to the attention of my dog. See thread "My dog - There is a mistake in the vote count." my dog responded dismissively, mewling "[w]e don't have a perfect system" and suggesting "[v]oating can be edited afterwords by pulling shenanigans." Despite clear evidence of the tied vote, my dog advanced colt.

Argument

Fraudulent concealment occurs involves the deliberate suppression of a material fact by a poster with an intention to deceive or defraud other posters. my dog fraudulently concealed that certain posters, namely melania, would be permitted to vote twice and have their votes counted twice. my dog did so with the intent to deceive posters to ensure a high rate of participation in MPM.

Fraudulent inducement requires a poster to establish that it “reasonably relied” upon promises of future conduct made by another party. Certain autoadmit posters were fraudulently induced to nominate and participate in MPM based on their reasonable reliance that my dog would conduct the tournament in an impartial manner. He neglected to do so by permitting double voting.

Abuse of discretion occurs where discretion is exercised improvidently and without due consideration. It occurs where a moderator's or other poster's decision is clearly against the logic and the facts of the case. Here, my dog failed to give due to consideration to lawman8's argument that melania voted twice and thus tainted that branch of the MPM process. Instead, my dog deliberately misread lawman8's post to suggest that lawman8 was complaining about alts (although alts are not the subject of this motion, there is also evidence of widespread abuse of alt voting). my dog concluded that "[i]t is impossible to know at this point what the voats were when I locked the thread and counted." my dog's review and determination was an abuse of discretion.

Relief

Autoadmit posters request that MPM Round 4 be immediately be enjoined from operating and that a truly impartial tribunal can be assembled to review the double-voting in the lawman8 v. colt match up in Round 3, and all further relief that is deemed necessary.
