Car accident case. Outer borough. Minority jury. Plaintiff is Puerto Rican/Mullata. I am defendant and white. Plaintiff’s attorney is a slimy old Jew with a history of ringing in big verdicts.

Don’t want to get into the facts of the case but it’s egregious that it has gotten this far. My insurance company is incensed that this is going to trial. Only real issue is if my version of events is more credible than plaintiff’s.

Plaintiff’s attorney is apparently going to attack my credibility all day.

Pretty much at every trial the offer goes up the first day of trial or right around that time. Seems like trial has started and 30 is the final number. No way they’d offer up the 100 if they’re only offering 30.

God I fucking hate lawyers. Brutal cross examination. I am a short tempered guy with a “sharp tongue” and it took everything in me to not eviscerate this kike shitlawyer. That said, I did manage a few jabs that elicited chuckles from the jury.

My attorney made an egregious error that resulted in a key piece of evidence being excluded from evidence. He did a good job at preserving the issue for appeal but I don’t know...it undercuts our entire defense.

Apparently plaintiff’s demand was 2.25m and insurance company didn’t even counter with 30k, they authorized the attorney to do so and he didn’t because he felt it was futile.

The judge did me a favor and put on the record that he didn’t accept the evidence because X reason and X reason was my attorney’s fault.

Verdict is expected tomorrow. Once that happens I’ll reveal more.

But fuck these people.

There are a few bad faith issues here that may complicate things, also, this isn't CA so who knows if law is different in New York.

1. Is the umbrella insurer the same as the primary insurer? Primary insurer could potentially argue that the policy is not open and unlimited because no policy limits demand was made within the primary policy limits.

2. The umbrella insurer could potentially say that since the primary carrier was handling the defense and the policy was never exhausted, they never had an opportunity to settle within the policy since the primary policy never offered up the limits.

I've never had this issue before but that was just what crossed my mind. Always expect an insurance company to fuck you over OP.

After the defense attorney moved to dismiss based on corpus delicti, the judge gave her a recess to consider responses. I found an applicable binding court case that helped and told her what the counterargument supported in the case was. She ignored it, raising some bullshit birdbrain counterargument instead. When the judge literally tried to lead her to the correct argument (i.e., the case I found), she ignored him and kept plodding down her bullshit path.

It’s not completely his fault. Case was originally with a medium sized ID firm. He was contracted for the EBT and only recently was contracted for the trial. That being said he apparently has been doing the grunt work for the matter, with a partner signing the motions etc. I doubt he had the authority to contact me. The ID firm definitely did though.

10 percent fault for me, 90 percent for co-defendant (whose attorney was basically second counsel for Plaintiff) joint and several. Co defendant is judgment proof, and barely has a policy so I’m fucked if this pops the policy.

Insurance company is now “considering” offering to settle the case for policy. Plaintiff did bad faith thing on the record after the verdict. This morning plaintiff’s attorney said he thinks he can get $5m, which my retarded attorney thinks is way too high of an estimate.

She claimed I swerved in front of them. The biggest piece of impeachment evidence was kept out of evidence because my attorney didn’t realize he needed an expert to talk about how some sort of archaic alcohol per blood part measurement done in the hospital tox report 3 hours later related to her level of sobriety at the time of the accident, after losing a lot of blood.

****EDIT: By she I mean the passenger. The driver, after pleading to felony DWI absentee herself from the state and only the insurance defense attorney showed up (same insurance co as me). She was youngish (almost not young anymore) and dumb. She crossed me intensely (but without knowing what I would say). The worst part about it was they sent my car spinning into two guys on motorcycles, neither of whom are in this case bc they fled the country due to their status. When she hit me we were both in the right land and when she jammed on her brakes she tried to veer off the road, hitting the back of my car on the passenger side, sending me spinning into the left lane into two bikers. It seemed like slow motion but I remember watching myself sliding into the biker, making eye contact with him and then seeing him collide into my passenger front side and then disappear under my car. Nightmares for years.

This is really a situation where you should have turned on your insurance company (and maybe still should), although after the deposit and trial it's a bit late. But there had to be some way to partially settle directly with the plaintiff and get them not to pursue an excess judgment in exchange for some type of nominal consideration so you wouldn't have an incentive to fuck over their case with your testimony. Maybe doing that breaches your insurance agreement.

I think he took this out of a text book:

In Berry, plaintiff was a passenger on a city garbage truck which collided with the defendant. The jury found the garbage truck driver (who was protected from liability by the exclusive remedy of Workers’ Compensation) 70% at fault and found the defendant 30% liable. The defendant argued that adoption of the contribution among tort-feasors act had the effect of reversing Laubach since one of the Court’s rationales in Laubach was the unavailability of contribution.

The Berry Court rejected this argument, holding that, since the plaintiff/passenger in Berry was negligence-free, he was still able to recover joint and several liability. And that’s where the law remained from 1980 until 2004.

Then the legislature enacted the first of several versions of 23 O.S. § 15, effective 11/1/2004. Under that statute, joint and several liability applied only to defendants so long as the negligence attributed to that defendant was greater than 50%. The statute did not apply to a defendant whose negligence was willful, wanton or with reckless disregard for the consequences of the conduct or if the plaintiff was found to have no comparative negligence. This version of the statute was effective as to injuries occurring between 2004 and 11/1/2009.

If multiple parties are "jointly and severally liable" for a debt, then the creditor can collect the full amount from *any* of the debtor parties.

So if you've got poormo, poormo, and richmo jointly and severally liable for $10 mil, you can collect the full $10 mil from the richmo. The richmo, in theory, can then collect from the poormos, but good luck squeezing blood from a poormo stone.

OP, if I didn't think you were flame, I would help you out with this. If you are not flame, you shouldn't have much concern about personal exposure. You said you had a friend help with drafting a letter to your insurance company. Is he experienced with post-judgment coverage/extra-contractual litigation? If not, you need to talk to someone ASAP who is.

The good news is that the type of personal counsel you need at this point is a plaintiff's attorney, who likely will be happy to take your case on a contingency fee basis. Ask some older attorneys for recommendations on plaintiffs attorneys who are experienced and competent with this type of shit. If that doesn't work, figure out your jurisdiction's name for the type of claim an injured claimant pursues against the tortfeasor's insurer to collect on the policy following entry of judgment in the underlying liability suit, search Westlaw for such cases (perhaps in conjunction with "bad faith"), and try to identify a couple attorneys' names who keep popping up in those cases. If there are any such attorneys from the same town as the attorney who is suing you, start with calling them.

Question for the PI lawyers: Let’s say he’s popped for $5 million. Insurance company pays $2.5. Is OP’s claim for $2.5 million? And then if he wins his attorney gets fees and he has to give the $2.5 million to plaintiff? Or does a bad faith claim offer him an opportunity to profit? Should he be getting mental duress/medicals? I think, essentially everywhere, a bad faith claim allows recovery for emotional damages. In my state, a bad faith plaintiff can't recover attorney fees in a case like OP's.

Are you guys mixing up bad faith with attorney malpractice?

Under these facts I don't see how any insurance company would be reasonably expected to tender anything (unless the state has weird fucked out laws on joint liability).

On the other hand, the carrier appointed attorney seems like he may have fucked up more than once. Is that bad faith too? I would think that's just attorney malpractice.
