It is crucial that you take affirmative steps to preserve both paper documents and electronically stored information that are relevant to this dispute and that are in your custody or control.

The time period at issue in this case is January 1, 2019 to the present. Although this time period might be adjusted as the litigation proceeds, this date span is a good starting point to assess the materials you should preserve.

The complaint is mostly about "false and defamatory gist" rather than specific statements by the Post. The Post mostly used quotes from other people to create their spin, and it's much harder to make the case of "they selectively chose negative quotes to make me look bad" than "the Post negligently published x as fact when in fact it was false".

However, the headlines the Post used do veer into that territory. For example, "Marcher's accost by boys draws ire"--that's arguably making a factual statement (that the boys accosted the marchers rather than the inverse) that the Post knew or should have known was false. There's not much there for the plaintiffs, but maybe with a decent judge this would get past this dismissal.
