The back fence along the rear end of our property line adjacent to the house directly behind us has collapsed.
Apparently the owner of the house directly behind us, Mr. Wang, rents that house out.
I proposed to Mr. Wang and his wife that we go halfies on repair and he told me 1) he’s not responsible for the fence as its not on his property and 2) he didn’t put the fence up--it was there when he bought it.
Obviously this is annoying nonsense and he should just do what I proposed as that is more than fair but we determined that the fence may be partly on his property and partly on mine (because of the treeline), or it may be solely on his property, or it may solely be on my property.
I have offered to pay half the fence replacement cost if it is entirely on his line or if it moves between the two property lines. And I would pay 100 percent if it is on my line. Utterly fair, I think—a win-win for him and for me, because I want to get the fence back up.
But he wants a land study (at my expense apparently) to make this determination—that is, to determine where on the properly line the fence is.

I should add that my realtor told me that the fence was on the neighbors property line at the time i bought the house. That is also consistent with the way the fence is facing.
The Chinese guy bought it FISBO style from another neighbor, who told the Chinese guy that the fence was on my property. That neighbor, the neighbor who sold the house to the Chinese guy, joined in the conversation and started to argue with me all sorts of nonsense as well.

And I was totally cool and told him i would go halfsies if it was on his property but he didn't even want to do that and contested whether it was on his property at all or not.
Lol his freaking Chinese wife started trying to sell me on the theory that whichever homeowner put up the fence was responsible and the FISBO seller tried to tell me the fence was up when HE bought the house so it must have been my previous owner who put the fence up. JFC. Just accept that I'm being totally nice and fair about it--I just want you to chip in, Mr. Wang.

My realtor said it was his, its turned outward like its his, and his neighbor (who's house is also behind mine but further to the south so only a bit of the same fence is shared as between us but that part of the fence hasnt fallen down) actually confessed to me that his portion of the fence was actually on his property line, but he thought the fence meandered between the two property lines on the relevant part. Of course he said that because he was the one who sold the house to MR. Wang to begin w, FISBO style, and he had represented to Mr. Wang at the time Wang bought the house that the fence was on my property not his.
I just want the landlord to pay his fair share. I'm not into maintaining other people's property altogether for gratis. 50/50, okay, but not all on me unless the fence is on my property to begin with.
It irritates me this chinese LL wants to argue with me when I'm giving him a great deal as it is.

Right.
It would technically be something along the lines of "Cleaning up his mess" costs for a fence that was below local regs, as well as nuisance and trespass, as the fallen boards and posts are now most definitely in my yard.
It's not hard to be creative enough to get into court. Remember Ive been doing this for a long ass time.

im actually with OP here.
something happened to his neighborhood and he wants to fix it. I think everyone else in the neighborhood besides the Chinese guy wants the same. He proposed a very reasonable solution irl. He has stated repeatedly that he's not interested in being a litigious jew. he just wants to smoke weed in his backyard in private, and doesn't want to look at this destroyed fence all fall, when it will freeze over and rot in the winter and by spring, the demo costs will 3x when everything thaws and gets half buried and fucks up the landscaping.
How far is the fence from his house? You could say, okay, I'll DIY but I have a 9-5 so it's gonna take me some time and I'll have to work at night. Then shine massive floodlights into his house

In my opinion, the credited response here, is just to take the fence debris away and let it be. Maybe the neighbor will fix it at his expense after all?
This fence sounds like it was some relatively cheap 4x4 post with pickets or framed sections.
If you want the fence, build it yourself and absorb the cost.
If you don't want the fence, let it be open.
Maybe build a fence later to sell your house if need be, but until then, just let it be.
It's stupid as shit to try and get your neighbor to go halfsies on costs. Of course his response is going to be no. That's what neighbors do. they say "no." Welcome to suburbia.
