so if there was a group of 20 or so people who were texting with Tyler and if they knew about the plan to shoot [edit: Kirk], what else is necessary for a conspiracy charge? some overt act?

suppose that a few of them tweeted out predictions of something bad that was about to happen. that's not an overt act in furtherance of the conspiracy, is it?

[i initially wrote that that Tyler discussed his plan to shoot Tyler.]

If you're talking about a conspiracy against rights under federal law, no overt act is required, just agreement.

"to injure, oppress, threaten, or intimidate any person of any state, territory or district in the free exercise or enjoyment of any right or privilege secured to him/her by the Constitution or the laws of the United States". Probably the best argument is that they were all in on an attempt to scare right-wing polemicists into silence by murdering the guy (and of course that they were doing to to retaliate against him in the exercise of his 1A rights).

If you're asking what the state could do, I don't know what constitutes an overt act under Utah law. I'm just saying that that would be the best avenue for a federal conspiracy prosecution. It would probably be harder than a state prosecution, depending on what an overt act was and what was done.

For conspiracy against civil rights, you don't need an overt act, but you do need the defendant (a) to have "agreed with another to" deprive the victim of his civil rights and (b) to have "intended to" hinder the excercise of the right. It's hard to see how passively being on a text chain and tweeting a prediction meets those elements.

For the more general federal conspiracy statute, you explicitly do need an overt act in the 10th circuit, so you'd be even further under OP's hypo.

2.16 CONSPIRACY TO DEPRIVE PERSON OF CIVIL

RIGHTS 18 U.S.C. § 241

The defendant is charged in count ————— with a violation

of 18 U.S.C. section 241.

This law makes it a crime for two or more persons to conspire

to [injure] [oppress] [threaten] [intimidate] someone in the free

exercise or enjoyment of any right or privilege secured by the

Constitution or laws of the United States.

To find the defendant guilty of this crime you must be

convinced that the government has proved each of the following

beyond a reasonable doubt:

First: the defendant knowingly agreed with another to

[injure] [oppress] [threaten] [intimidate] one or more persons;

and

Second: in doing so, the defendant intended to [hinder]

[prevent] [interfere with] [name of person]’s exercise or enjoyment

of [his] [her] right [name right, e.g., to vote], which is a right

secured by the Constitution or laws of the United States.

[Third: include any statutory enhancement element, e.g.,

[name of person] died as a result of acts committed in furtherance

of the conspiracy.]

[The government need not prove that the defendant intended

for [name of person] to die. It must prove that [name of person]’s

death was a foreseeable result of the defendant’s conduct.]

2.19 CONSPIRACY 18 U.S.C. § 371

The defendant is charged in count ————— with a violation

of 18 U.S.C. section 371.

This law makes it a crime to conspire to commit an offense

against the United States.

To find the defendant guilty of this crime you must be

convinced that the government has proved each of the following

beyond a reasonable doubt:

First: the defendant agreed with at least one other person to

violate the law.

Second: one of the conspirators engaged in at least one overt

act furthering the conspiracy’s objective.

Third: the defendant knew the essential objective of the

conspiracy.

Fourth: the defendant knowingly and voluntarily

participated in the conspiracy.

Fifth: there was interdependence among the members of the

conspiracy; that is, the members, in some way or manner,

intended to act together for their shared mutual benefit within the

scope of the conspiracy charged.

Comment

By the text of the statute, proof of an overt act is a required element in

conspiracies charged under 18 U.S.C. § 371. United States v. Martinez-Cruz,

836 F.3d 1305, 1313 n.6 (10th Cir. 2016) (quoting text of § 371 that requires

overt act). But proof of an overt act is not required in 21 U.S.C. § 846

conspiracies. United States v. Shabani, 513 U.S. 10,

13 (1994).

EXCLUSIVE: The FBI is investigating social media posts by at least seven different accounts that appeared to indicate foreknowledge of the assassination of Charlie Kirk, according to three people familiar with the investigation and screenshots obtained by the Free Beacon.🧵

The posts—one of which referenced the date of Kirk’s assassination, September 10, more than a month before it took place—were all deleted in the days following the killing.

Aaron Sibarium

@aaronsibarium

·

7h

Several of the accounts appear to belong to transgender individuals, and at least one of them followed suspect Tyler Robinson's roommate, with whom Robinson was allegedly in a relationship, on TikTok.

Aaron Sibarium

@aaronsibarium

·

7h

The FBI has received archived copies of the posts, according to a person who flagged them for the agency. Screenshots of the posts have been circulating online but had not been previously authenticated.

Aaron Sibarium

@aaronsibarium

·

7h

While the posts do not establish that any of the individuals knew or conspired with Robinson, the 22-year-old gunman who allegedly shot Kirk, several of them mention the conservative activist by name and fantasize about his death.

Aaron Sibarium

@aaronsibarium

·

7h

"itd be funny if someone like charlie kirk got shot on september 10th LMAO," one X account posted on September 3.

Aaron Sibarium

@aaronsibarium

·

7h

Another account posted on August 6—more than a month before the shooting—that "september 10th will be a very interesting day." After Kirk’s assassination, the account followed up: "I plead the fifth.

Aaron Sibarium

@aaronsibarium

·

7h

The morbid quip was reposted by an account named "churbum75m (SAW TYLER JUNE 30)," who appears to follow Robinson’s roommate, Lance Twiggs, on TikTok, where Twiggs’s username is "lanclotl."

Aaron Sibarium

@aaronsibarium

·

7h

Minutes after Kirk was pronounced dead, churbum75m posted on X: "WE FUCKING DID IT."

Aaron Sibarium

@aaronsibarium

·

7h

Several of the accounts under investigation appear to be associated with LGBT subcultures. One individual, "Osamu bin Tezuka," used the X handle "

@fujoshincel

," a reference to a genre of anime that depicts romantic relationships between men.

Aaron Sibarium

@aaronsibarium

·

7h

Another user, "

@NajraGalvz

," who had wished death to Kirk and predicted that "something big will happen" when he set foot on campus, had identified as nonbinary on X.

Aaron Sibarium

@aaronsibarium

·

7h

And in a video posted on TikTok the night before the shooting, an individual who appears to be transgender wrote that "charles james kirk…does not know what’s coming tomorrow."

Aaron Sibarium

@aaronsibarium

·

7h

"This isn’t a threat," the individual added. "It’s a promise."

Aaron Sibarium

@aaronsibarium

·

7h

The investigation of the posts comes as the FBI is already examining whether pro-transgender groups knew about Robinson’s plan in advance. That probe, first reported by the New York Post, includes Armed Queers SLC, whose logo features high-caliber rifle bullets.
