Did the Trump administration argue in court in the Abrego Garcia case that it could deport a US citizen and once they’re in foreign custody there’s no remedy to return them?
Yes — in the Abrego Garcia case, the Trump administration did make exactly that argument. During the emergency proceedings in April 2025, the government told the courts that:
• Once Abrego Garcia was deported and held in Salvadoran custody, the U.S. courts lacked authority to “extract” him back—even though the deportation itself violated a U.S. court order .
• They contended that the president’s power to conduct foreign affairs meant U.S. courts couldn’t compel diplomatic engagement or enforcement in a foreign country .
This argument implied that if the federal government could deport someone—even wrongly—to foreign custody, there might be no legal mechanism for courts to force their return, since the person is “beyond the court’s reach.” Justice Sotomayor flagged this very concern, noting such a position “implies that it could deport and incarcerate any person, including U.S. citizens, without legal consequence, so long as it does so before a court can intervene” .
⸻
✅ Judicial Pushback
• District Judge Paula Xinis rejected this reasoning, ordering that the administration take “all available steps” to bring Abrego Garcia back, not merely remove domestic obstacles .
• The Fourth Circuit unanimously agreed, stating that the government’s stance was “unconscionable” and that courts do have jurisdiction to enforce returns, even from foreign custody .
• The Supreme Court, in a unanimous order, affirmed that the government must “facilitate” the return, implicitly rebuking the argument that international custody nullifies U.S. judicial authority .
⸻
🧠Bottom Line
The Trump administration did argue that once a person is overseas—held by another country—U.S. courts have no means to compel their return. But that argument was overruled at every level, and the courts reaffirmed that they can—and must—enforce return orders, even into foreign jurisdictions.

it's pretty easy dummy.
"what's your social security number we're gonna check it in our system"
*starts running away*
beyond this point due process is unnecessary and impractical. i'm sure DHS is doing at least this level of due process before deporting these people, who again, broke the law on their way in thanks to shitlibs letting them in. now you care about process? lmao

Again. This used to be a law forum. Sad as fuck
So you're saying SSN=citizenship/valid residency? Fucking lmao. Illegals get SSNs all the time. There are 100s of SSNs used by dead people.
"due process is unnecessary and impractical"
Get the fuck out of my country. You don't know or respect the law here. You need to go back to whatever shithole your parents escaped from.
"i'm sure DHS is doing at least this level of due process before deporting these people"
Yeah bud. Hey everybody it's ok, ParaMo is "sure" that they're checking. Get real
"who again, broke the law on their way in"
Innocent until proven guilty, you fucking retarded mudslime faggot. Go back to your country if you don't respect our laws
"thanks to shitlibs letting them in."
Oh but you posting online on a nearly defunct message board was really really helping
"now you care about process?"

This is what happens when we completely fail to enforce immigration laws for decades. It breeds entitlement and they wave their Mexican flags proudly.
Hell, it’s literally *illegal* for law enforcement to assist with enforcement of immigration law in California or even ask about immigration status. My shitlib town in Los Angeles County sent us an email today reassuring us that they are definitely not helping ICE (no mention of any efforts to protect us against rioters though).

“ I hate paying so much in taxes to live in a total dump while providing benefits for these entitled pieces of shit, and feeling like I’m taking crazy pills because everyone around me supports them over me.”
This is what white males have felt like every day since about 1996.
Also, they are concrete bollards, not bollocks. Figure that was autocorrect though.

It’s really fucking rich that Trump voters suddenly care about cops getting attacked for enforcing the law:
“According to Justice Department figures released earlier this month, approximately 1,583 defendants have been charged with crimes associated with the riot.
More than 600 have been charged with assaulting, resisting or obstructing law enforcement, including around 175 charged with using a deadly or dangerous weapon or causing serious bodily injury to an officer.“

It’s mind boggling to see people who supposedly have left Mexico because it’s such a shit hole waiving Mexican flags around here. If they are so pro-Mexico, they should go the fuck back.
If I were the president, I would send the national guard in to mow these motherfuckers down Kent State style. If we keep having BLM style looting protests we are not going to have a country for very long. The left needs to stop legitimizing looting and violence. Their followers are too stupid to resist the call.
