I'm trying to buy a house - i toured it with the seller's agent and emailed her bullet points of my terms. I tell her I'm not represented by a buyers agent so that should be a savings to the seller under the new rules.
She responds the next day and she starts sending me an official "offer" on the state's realtor form. I work with her to check a box that she misses and then after a tremendous amount of back and forth, i sign the "offer."
She then comes back that the seller wants to counter on price. I'm like - wtf is this? I told you the fucking price 40 hours ago - why are we doing all this work if you didn't get a meeting of the minds on the most basic terms.
Then the next day she says the seller is going to go with a different offer.
This is the second time this has happened to me, where there is ZERO attempt by the seller agent to even ask or give me the opportunity to beat the other offer.
It's like these real estate agents think them doing these stupid forms is how they add value, and not trying to negotiate a higher price for their client when there's multiple interested parties.
Also, I'm 90% she never told her client they'd save $50,000 in agent fees by going with my offer.

I don't think this is true.
The court ruling says buyer has to pay their own agent - can't come from the seller.
So now buyers are just signing contracts with agents and then the parties stipulate that the seller is paying.
I strongly suspect that they're colluding against people trying to actually change the sysem from the court order from the old system - which they are trying to de facto recreate with contracts and collusion.

The new rule is that the seller can't determine the buyer agent commissions anymore - the buyer agent is supposed to agree with the buyer of the commission upfront.
I think you're correct that the end result is still that the settlement statement the seller pays this fee out.
But in my scenario, that line item would be 0. What is happening in practice is that it is still 3% and the seller just pays it.
I'm sure sellers agents don't want to start the precedent of that line item being 0...

You're basically saying, "it doesn't matter if a buyers agent is getting 0% or 3% because the price is fixed" ...which is...price fixing....

This is how deals are done in every other context.
There's literally only 6 toggles on their fucking form. I told her the terms we were willing to do for each toggle.
Why on earth would i need to wait for her to put it in her special REALTOR software for her to tell her client?
Literally here is the system you think makes sense:
"Me - Purchase price is X, depoit is Y, we need this contingency but not that contingency, they can pick the closing date, inspection period is Z days."
Then she goes into her special REALTOR software and spends 2 hours drawing up an "offer" with that, i have to sign it.
Then she goes to her clients and says, "Okay i just got the offer, "Purchase price is X, depoit is Y, we need this contingency but not that contingency, they can pick the closing date, inspection period is Z days."
And then when her client counters, they write up another counter offer that they sign with different terms

Oh and btw, not only would my way of just negotiating a term sheet of the 5 terms save us hours, it saves the seller $50,000 in realtor fees....

Why would you NEED to do this inefficient process? Why would you need a "bid documented"?
There's no other contracting process in business as stupid as this one. It's just realtors justifying their existence.

You are bidding on a home that had other bidders. In order for the owner to decide, they have to see the bids. The bids must be written. This is basic stuff.
You apparently approached this thinking that the sellers agent was supposed to negotiate a deal price with you personally on the side and to the exclusion of all the other buyers (who were submitting written bids) and which you had no idea were higher and lower than yours.
Why would the owner just agree to a deal with you and ignore all these other written bids and handicap themselves like that? Why would you expect the agent to just work out a verbal deal with you for a final price when there are other bids to be seen?

Your scenario isn't applicable here. The house had been on the market 3 weeks.
I get that if they're trying to get multiple bids in by X date.
But also, even in that scenario, why wouldn't the agent go back to the second highest bidder and go - the top bid is Y - do you want to top it?
What's the utility of an agent who is just presenting you with the offers?

when i actually had to deal with them i quickly discovered they are lazy morons who check some boxes and mostly care about photo shoots.
if you eventually discover a good one, treat that relationship like gold.
