If he says, “oh yeah, I wanted to shoot that bitch,” then yeah he should be arrested and charged. If he says, “I was concerned about her because she wasn’t following lawful orders, in my experience and training, people that don’t follow orders may be that way because they may not understand, may not hear you, may intend you harm, maybe aren’t capable. In this case I thought she intended us harm based on her demeanor and everything I had observed before. When I started to see the car move I believed that she had the intention of running into me and causing me serious bodily injury or death” then no I think he shouldn’t be arrested. |
