Not faulting him for doing his job. Just saying the system is retarded.
80% of the time, some psych opines that D is competent and that's the end of it. The other 19% time, he opines that D needs to be involuntarily medicated, and then D is and then stands trial. Very rare to have someone actually declared incompetent.
It's also hard to have a record of lack of competency if defense counsel dosn't raise it in the first place. It wouldn't be evident from the record in msot cases.
