EDIT: I should note that it’s still a shocking (albeit temporary) loss after the OA, and the Notre Dame religious liberty clinic or whatever should probably reconsider its participation in scotus cases at this point if it's going to mean the deciding vote recusing herself.

i could be wrong but i think the COA struck down OK's approach and the 4-4 vote at SCOTUS means the COA's opinion governs that case but the issue is still open at the SCOTUS level. sort of, "a tie at SCOTUS goes to whoever won below."
