Restrictions on free speech are only justified if they are necessary to protect other people. We don't need a First Amendment to protect non-controversial speech. It's the really disgusting speech that needs to be protected.
To be clear, I still think it should be banned, but not on obscenity grounds. As I said above, there's no good way to determine what's real and what's fake, and I worry about some creep creating deepfakes of a 6th grader. But if you could allow AI-generated kiddie porn while prohibiting the real stuff and deepfakes, then it should be protected speech IMHO. |
