They have hard evidence from the wiretap that Donna knew about the murder after the fact. And they're going to try and tie that to her having a motive and to financial transactions. This one is the hardest to go through. We know Charlie set up the murder for hire. The state is going to try and prove he did it on behalf of Donna. Wendy certainly knew of this but they can't tie her to it right now. They would need Charlie or Donna to flip and that seems like a longshot. As I recall, there was testimony during Charlie's trial to the effect that Harvey knew nothing about the plot and was very upset when he heard about it. On the other hand, I think the circumstantial evidence against Wendi is very strong. As I recall, there were a bunch of calls between her and Charlie right before the murder happened. On the morning of the murder, she drove past shortporch's house even though it was a major detour on her route. And when she saw crime scene tape at the house, she didn't stop to see if her kids were okay. And there was testimony from one of the hitmen that Charlie insisted that they drive a certain model and color of car, which was the same as Wendi's boyfriend was driving at the time. It's not airtight, but people have been convicted on far weaker evidence than this. My guess is that unless they can find new evidence that can definitely prove that Wendi is involved, they won't arrest Wendi until they either get Donna or Charlie to roll over (or give up on trying). There was a rumor that the DA's office offered Donna a plea deal for time served if she would give up Wendi, but Donna refused. The DA's office denies this, so who knows?
