SOL is an affirmative defense. That is, it has to be affirmatively raised by the defendant to apply. Therefore, the debt itself, which may or may not be collectible ultimately, is indeed “collectible” at least until the SOL is affirmatively pled. Once it has been affirmatively pled, then it is a defense on the board but not until then. Nor does simply pleading it in a response retroactively make the original collection effort invalid or a violation of collection effort law. The debtor has to prove that the SOL has passed without extension.
So, simply trying to collect on an old debt, without more, is not a violation of debt collection laws. It’s up to the debtor to raise the defense. It’s not bad faith or bad collections practice simply to try to collect.
The judge could have eliminated all or nearly all of TSINAH’s claims had the bank simply argued this. It sounds like she wanted to — she just hadn’t thought it thru because the whole situation was fucking ridiculous.
I wasn’t there but eventually the court will figure this out and when the court does the judge will do what she wanted to do and dismiss TSINAH’s claims that fall under this category.
Edit: obviously TSINAH’s claim is horseshit. What would it mean for debts and debt practice if he were right. It’s just plain silly.
But what do I know. TSINAH’s adamant that he’s a better atty than me.

I can’t remember the”analysis” but if you actually knew what you were talking about that wasn’t even the issue before the court. … the issue, as framed, was simply whether a federal sovereign immunity statute applied to bar a claim for blasting sound at someone as a “battery” when my states law doesnt recognize sound blast as battery. Nothing to do with intentionality — that was a distraction that sent a judge down a rabbit hole and they set it straight in the decision which did address the actual issue on appeal. For example, there is a line of cases in my state holding that it is sanctionable under the state equivalent of Rule 11 for an attorney to plead a claim that he knows is barred by the SoL if asserted, with the courts arguing that an attorney cannot avoid sanctions just because there was a chance opposing counsel would mess up asserting the affirmative defense.
I don’t agree with this reasoning, but it’s out there. I could see the same argument being adopted in a consumer protection situation. |

A sudden mysterious payment from an unknown person appearing right now could lend credence to that argument “I dunno judge people just pay stuff for me sometimes because I’m an internet celebrity and here’s an example of that right now” |

Date: April 3rd, 2024 12:29 PM Author: Fear-inspiring Stage ZZZ probably didn't know to invoke the federal statute. this isn't a dig at him or his intelligence or whatever, but this is a good example of why it's essential that new lawyers train under someone experienced before they go out on their own. so easy to miss things that in retrospect appear to be "obvious" (but aren't).
that said, ZZZ went to a TOP THREE law school, got a 170 on the LSAT, etc. so wtf do I know? I went to a state flagship and am a partner at a non-biglaw firm. |
