Suppose I have a hot dog stand, but in order to buy a hot dog you're required to have your picture taken in next to in front of a sign that says "I support this person's political agenda." I keep all copies of the pics. The text doesn't explain who the "I" or "this person" refers to in the pics. No other identifying info is included.

IT DEPENDS. some jdxes have expansive anti-discrimination laws that include political affiliation as a protected trait and cover public accommodations. if in such a jurisdiction, you might have an issue. otherwise, you might not.

Do these state laws have a foundation beyond the 14th amendment? I mean suppose the 14th amendment were held not to prohibit this kind of discrimination, or to even call it "discrimination" at all. I would argue that any state law or constitutional provision that prohibits such discrimination infringes on my freedom of association. What means of association is more American than selling hot dogs and lemonade and why is Minnesota telling me how not to do it?

AFAIK the laws are passed pursuant to the general police powers of the states, and while i am sympathetic to your freedom of association arg, basically any "anti-discrimination" law affecting a commercial "public accommodation" is gonna get relegated to some sort of trash tier of "rational basis" scrutiny or some such.

CA has similar laws protecting employment based upon political views, but I think the libs thought the laws were just to protect libs.
