Yes — in the Abrego Garcia case, the Trump administration did make exactly that argument. During the emergency proceedings in April 2025, the government told the courts that:
• Once Abrego Garcia was deported and held in Salvadoran custody, the U.S. courts lacked authority to “extract” him back—even though the deportation itself violated a U.S. court order .
• They contended that the president’s power to conduct foreign affairs meant U.S. courts couldn’t compel diplomatic engagement or enforcement in a foreign country .
This argument implied that if the federal government could deport someone—even wrongly—to foreign custody, there might be no legal mechanism for courts to force their return, since the person is “beyond the court’s reach.” Justice Sotomayor flagged this very concern, noting such a position “implies that it could deport and incarcerate any person, including U.S. citizens, without legal consequence, so long as it does so before a court can intervene” .

Hell, it’s literally *illegal* for law enforcement to assist with enforcement of immigration law in California or even ask about immigration status.
