Buddy of mine just moved out and took pictures and everything. Was perfectly clean, no damage. Landlord withheld part of his deposit to replace the carpet. No mention of why. I’m guessing they do this to every tenant and it’s too much trouble for most people to fight it. But you get treble damages and attorneys fees so should be a fun case. And I might try to find other tenants to sign up.

a lot of jurisdictions require landlords to do basic renovations like fresh paint and carpets every 2 years. check to see if that's the case. they may have even been obligated to do it before he moved in or while he was there, so they may OWE him. keep in mind that the biggest TTT retards work in landlord-tenant law, and many landlords dont even consult lawyers, so these cases are easy to win. i once secured a $300k payout for my friend to leave her shitty NYC apartment even tho it was questionable whether she ever had a valid lease or it was rent stabilized. unfortunately, this dumb bitch decided to pass on that as long as she didnt have to move out.

(c) Any landlord who fails to return any part of a security deposit which is required to be returned to a tenant pursuant to this article shall be liable to the tenant in the amount of three times the sum improperly withheld plus reasonable attorney's fees; provided, however, that the landlord shall be liable only for the sum erroneously withheld if the landlord shows by the preponderance of the evidence that the withholding was not intentional and resulted from a bona fide error which occurred in spite of the existence of procedures reasonably designed to avoid such errors.
