Bitch killed her 3 kids after sending hubby to pick up dinner. Then she crushes and swallows 30 pills, slits her throat and wrists, jumps out a second story window (blood on the floor, nightstand, window sill). Freezing temps coagulate her blood, she survives despite the hospital sending out a code blue (death or dying patient). She's paralyzed from the waist down.

Prosecution claims it was a fake suicide attempt. They haven't established any motive in this case. Defendant was not having an affair, had no financial motive or life to move on to. For months leading up to the incident she told her husband she was fantasizing about killing herself and the kids. She went to see a half dozen shrinks who put her on Seroquel which made her worse. Dozens of pill bottles found for various psychoactive medications.

The plea is not guilty by reason of insanity. Prosecutor seems overzealous. There's also a civil suit filed by the husband against all her docs for wrongful death.

Yep insanity is the patrician's choice.

The claims the pros has made are beyond the pale. That she was manipulative (based on leaving the baby sister detailed notes on when to feed and put the kids to sleep?), that she "just didn't want to be a mom" (all the photos with the kids seem happy, she wasn't trying to go clubbing or anything crazy afterwards). The suicide attempt wasn't real (seemed like she did everything she could possibly to end her life and was saved by freezing temps).

Meanwhile we have months of her reaching out to medical professionals saying "I'm losing it, I need help" and they threw a ton of medication at her that made her worse and worse. Seems like the state is just trying to defend the medical profession at all costs. At one point she went to a women's home in Rhode Island for mothers with post partum and they rejected her because she "wasn't a good fit." Lmao wtf.

how can you be too good at asking for help? Anyone who tells their husband they want to kill the kids is asking to be 5150'd and sent off to the nuthouse. She also kept a medication log of everything she took and after every day wrote "horrible intimate thoughts." What was she hiding? What was the setup? Still no motive from the state. Nothing even proffered.

Sounds like a lot of failures to protect her and the kids by her doctors, her husband, the women's home, and the state. E.g., once it became clear enough that she was flailing and getting worse and a danger to the kids, the husband should have done whatever it takes to get them and gtfo.

Nonetheless, it doesn't sound like insanity, not any more than every mom who kills her kids is insane based on that alone. She knew what she was doing. She knew it was wrong. Therefore, she's not insane. The suicide attempt undermines the insanity defense, if anything.

Also, based on the above posts about the prosecution trying to say the docs were good: it sounds like they're taking the wrong approach and may fumble the case.

The prosecution theory is totally nuts and they're losing on their own terms. If the docs were good they need Lindsay to be doing something wrong. They said she checked herself out of treatment (after 5 days at McLean). They said she was pill shopping to get high (she said she hated benzos and wanted off them ASAP). The husband said she took every med diligently and was trying to get better. There's no motive, no malice. The manipulation claim was bunk. Everyone who knew her said she was a different person before the postpartum depression and psychosis kicked in.

Even if she's guilty, she's beating the charges the state laid out in their theory. Namely that she was a pill popping manipulator who wanted the easy way out and faked her suicide attempt. Literally none of that is true.

The only argument for criminal responsibility is that she did it premeditated. She googled how to kill, sent her husband out of the house (even though she had other previous chances like two days he was out of town and would invariably have had more). So if you think G based on that then I can't sway you. But factually the prosecution theory is very weak. A woman who was legitimately nuts and had no motive who reached out for help snapped. But literally nothing the prosecution is claiming is true.

Prosecution sounds like they are unnecessarily getting into extraneous details and losing the forest for the trees. There is no dispute that she did it. There is evidence that she made and executed a plan to do. And they have points to argue that the defense won't meet their burden (and it is their burden) to prove insanity.

What's the other stuff the prosecution is claiming? Why are they getting away from the core story?

I don't know but you're right they have allowed so much into this case that doesn't benefit them. Staking everything on it was a fake suicide attempt when they have photos of blood everywhere, the neck wound is a horrific gaping hole, and she's paralyzed for life is a really odd tack.

Not to mention the prosecutor is a fat woman with Hillary Clinton vibes who seems like she went to Suffolk Law and has risen to the highest level of her own incompetence, and the defense bro is a local Boston Chad who says things like "it was wicked cold that night" (this shit happened at like 5pm which is nighttime in New England already).

Lawyers often have the combined problems of trying to be too clever and trying to issue spot and address every little detail, when they should focus on hammering home the key, favorable points and not getting lost in arguing about these details, especially when they have the burden.

One legal analyst on YouTube said defense bro played it extremely cool on the worst day for the defendant. It was four hours of direct of all the first responders talking about the crime scene with three dead kids. He passed on every cross. Shortened the day, got it over with. The only thing he said all day was he thanked one officer for their service. He's running circles around the flatulent pros bitch.

A defendant in Massachusetts can be found not guilty by reason of lack of criminal responsibility even if they fully understood their actions were illegal/wrong, provided a mental disease or defect deprived them of the capacity to control their conduct.

Yes. Also another quirk of MA law. The burden is on the prosecution to prove that the defendant wasn't nuts. The defendant doesn't have to prove they were nuts. The jury instructions will ask if the state proved that she wasn't, but tie goes to the defendant if it's not beyond a reasonable doubt.

The state has to be running out of witnesses at this point, and they're not strong. Everyone is holding their breath for the defense experts. They will put shrinks on the stand to testify about all the well established side effects of the medication she was on. Psychosis is a known side effect. She told her husband repeatedly that the Seroquel was making her worse. They upped the dosage. Her docs threw more and more pills at her. I think the defense will wipe the floor by the end of it. After the defense's star witness it will be hard to convict a lady who reached out for help and had 13 different psychotropics shoved in her face. She's going to skate.

It's also cartoonishly obvious that the state is overcharging as a defense of the medical community because white collar shitlibs stick together. They're suing the fuck out of the docs and so the lawyers stepped in and said we can still fuck them. So obvious the coastal elite cabal. They all vacation in the same places. Fuck these effete liberal scum and the system they wield against the enemies of their interests.

Ok, yeah, she probably walks. Here's their jury instruction. It's hard to see how anyone is guilty when the state has the burden to prove beyond a reasonable doubt that they could have stopped themselves. I wonder if anyone has tried to get a philosopher expert in to opine on that.

The second way for the Commonwealth to prove a defendant

was criminally responsible for their conduct is for the Commonwealth

to prove beyond a reasonable doubt that, even if the defendant

suffered from a mental disease or defect at the time of the alleged

offense, the defendant nonetheless retained the substantial capacity

to appreciate the wrongfulness or criminality of their conduct and to

conform their conduct to the requirements of the law.

To establish that the defendant had the substantial capacity to

appreciate the wrongfulness or criminality of their conduct, the

Commonwealth must prove beyond a reasonable doubt that the

defendant appreciated – that is, that the defendant knew or

understood in some meaningful way – that their conduct was either

illegal or wrong.

To establish that the defendant had the substantial capacity to

conform their conduct to the law’s requirements, the Commonwealth

must prove beyond a reasonable doubt that any mental disease or

defect that may have existed at the time of the alleged offense did not

deprive the defendant of their ability to behave as the law requires –

that is, to obey the law.

A methhead robbing a gas station genuinely probably can't help himself when he's really jonseing. Just do make him not guilty because he really wanted to get his fix.

this case seems like a good application of it (though burden doesn't seem right). she told numerous ppl she was gonna kill the kids and took most/all steps available to her to avoid it, at great personal and physical cost, outside of leaving the house permanently

Putting aside Massachusetts' unusual standard (under which i think she'll be acquitted), she should be found guilty. She knew she was a threat to the kids. She knew hurting them was wrong. She should have done more to avoid it--whatever it took.

How do you think the husband feels? He was 100% sound of mind. She wasn't. She told him about hurting the kids. How do you not flip a switch and get her out of there? He seemed a little blue pilled and beta. He was stressed out by her insomnia. He was a kind and caring guy but T levels were disastrously low. He should have gotten far away from her until she was able to recover.

Yep. Absolutely awful. Should have done the needful once it was clear she was losing it and might hurt the kids.

Too many people just slide and let do because it can be tough to do what you gotta do. ("I know I should leave and protect the kids, but it could hurt my career because it will be tough to arrange child care this week, so I'll just keep doing what I'm doing and hope nothing too bad happens.") We're all guilty of that at times, though not in such an extreme way.

He seemed like he really cared about her.

Looks like he was doing tech sales at the tail end of Covid WFH and his wife was on maternity leave and seemed to be avoiding going back to work.

So he's mid level IQ, no biglaw superstar. Holding down 6 fig job possibly with growth potential. Probably has parents with money.

He looks like the type that has never said bitch cunt or nigger once in his life. Total normie slash white collar bot. He apparently liked skiing. Not a creative bone in his body. Vacant stare. Probably watches golf. No personality. Married a basic bitch. Modest home. He's gonna grind until he makes 250k and she adds another 85 from nursing. As long as you don't get divorced you're fine. Pretty rudimentary white collar bro of little note.

But when the chips were on the line he couldn't make the tough call. Typical soy boy. A real man would have ripped that cunt wife's skull off her spinal cord for getting close to his kids. A lib "man" isn't built for conflict.

A huge portion of men today, seeing the same things he saw, would not have pulled the trigger and done whatever they needed to do to protect their kids--due to some combination of lack of guts and burying their heads in the sand.

Yeah especially low T New England soy boys. A notably loathsome breed. It's an entire community whose ancestors haven't lived off the land since the 19th century. Of course the instinctual animal has been bred out of them. They think they can fight wars with words. They think guns are immoral. It's a very fucked up insular community if you think about it. This is what shortporch tp would be doing if he were still here. Teaching at HLS and spewing hate online against Israel's enemies.

Here is California much more reasonable jury instruction:

You have found the defendant guilty of <insert crime[s]>. Now you must decide whether (he/she) was legally insane when (he/she) committed the crime[s].

The defendant must prove that it is more likely than not that (he/she) was legally insane when (he/she) committed the crime[s].The defendant was legally insane if:

1. When (he/she) committed the crime[s], (he/she) had a mental disease or defect; AND

2. Because of that disease or defect, (he/she) was incapable of knowing or understanding the nature and quality of (his/her) act or was incapable of knowing or understanding that (his/her) act was morally or legally wrong.

CA had the loss of control element, but it was abrogated by Prop 8

California’s repeal aligned with a broader national trend. Following John Hinckley Jr.’s 1982 acquittal by reason of insanity for the attempted assassination of President Ronald Reagan (which relied on the MPC standard), both Congress (via the federal Insanity Defense Reform Act of 1984) and numerous states stripped the volitional "loss of control" element from their insanity tests, retreating to strict cognitive M'Naghten-style definitions.

Aaron Hernandez's fiancée got to keep all his NFL money because he killed himself while awaiting appeal. MA law says if you die before your appeal is heard the case is dismissed. This goes back to the 1600s when peasants be dying randomly all the time so their families could keep the dough if they bit it.

Local law is so quirky and fun!

In hindsight and considering the consequence of three dead kids it's easy to say things should have been done differently. But creating a system a priori that balances how much power we should give third parties to seperate mothers from their kids, how we judge them for how they use that power, actually taking care of the kids, providing mental health treatment with the best outcomes, etc. is very hard.

Women having bouts of hysteria that involve suicide ideation and threats are pretty common, particularily postpartum. If we took their kids away if they express these feelings we're going to need a lot of state childcare facilities and that family disruption will often lead to worse outcomes. Plus it'll chill women from expressing these feelings and seeking help.

Anyone who has experienced a loved one attempting suicide after discussing it with you knows how difficult it is to decide what you should have done differently. Putting the onus on third parties like doctors seems especially dangerous since they'll have very little context and will default to taking the most extreme intervention to mitigate their own liability. Empowering the other parent to seperate the children has so many hazards. Consider how protection orders are often weaponized when there's little danger. How many parents heading into contentious custody battles will accuse the other of being a danger to the children so they can sole custody?
