But I have a case now where the father gets $800K per year in disbursements from his Indian tribe's casino. I represent the mother and the algorithm is capped so we stipped to $4,000 per month and my client is pissed.
Now I'm hearing that there may be a way around the cap (yes I know you can plead equity to deviate from guidelines, but you still want the algorithm to back up the number you are asking for).
Its a crazy case. She aborted two babies for cars. She wanted the babies, he didn't so he promised to buy her a car for each abortion. He financed them. Now they broke up and he doesn't want to pay for them anymore. Sorry, I digress, I shouldn't derail the thread.
CSLG may have fucked up by retaining a non-family law attorney. He has too much at stake. It really depends on the lawyer SHE hires. Divorces are marathons, not sprints. He still has time to wise up and protect himself but if she went the cheap route like he did (a high probability she hired a family friend or some stupid shit), then he'll be alright (they'll both fumble around and leave a ton of money on the able). |

Courts are very skeptical of "below-guideline" agreements and you have to use special language for the court to accept it (e.g., "We are aware of the state guidelines and understand they are set for the best interest of the child blah blah."
But the policy isn't to "protect" the child. The money BELONGS to the child. The parent is holding the money in trust for the child, its not the parents' money. A little pedantic, but still. |

And yes, children can sue parents. I had a case a couple of years ago where the 14 year old filed a restraining order against both parents and they were both granted. We cannot get Xspouse to spit out a number higher than $4000 per month regardless of dad's income so its definitely capped.
My client was formerly with a biglaw family law firm and they couldn't get the software to go above $4,000 either.
But my client is a busy body and she apparently has figured out a way around it (she's going to go to law school she says) and plus I have a Claude Team account now so I'll figure it out. This case is on the backburner right now, I'm super busy. In fact, I don't know why I'm on here fucking around, I have work to do . . . |

He has a lot of exposure for child and spousal support. Good attorneys can convince a judge to deviate from the guidelines which can have enormous consequences depending on the ages of the kids. |
