T-2 years, 4 months from fucked: "Jim, looking at your review, there are a few signs of concern. You're only billing 2000 and 200 of them are pro bono. You got a below-average rating from Partner Fuckjob. I'd just be careful."

T-1 year, 4 months from fucked: "Jim, things aren't looking up. And now you've got two below-average ratings. Your billables are up, but so are pro bono. And it doesn't look like you're taking on significant work. We'll probably have an interim review."

T-10 months from fucked: "Jim, I don't know that things are going to turn around for you by the end of the year. You may want to be looking."

Back before the profession was fucked, everyone had at least 3-4 years before they were politely informed that they won't be making partner and should consider other options. They were given something like 6 months to find a new job, which invariably they did, either at another biglaw firm or in-house. Many partners even helped set these guys up with clients so that they would be grateful to the firm and relations remained amiable. Generally, people wouldn't even wait for that as people were getting various offers all the time.

Now we get people thrown out with little to no warning just because there isn't work and because no one is firing their careers are often over.

i dunno much about litigation in those markets but i would never switch from corp to lit for the sake of keeping a job. corp and lit are two different careers. if you want to do real estate/corp, then just do it and hope for the best. if you just want to be employed then it might be worthwhile to switch depending on whether lit is busier at your firm than RE/corp.
