Internet harassment, the anonymous kind, is now a federal crime.

The Communications Act of 1934 criminalizes anonymous harassment by a telecommunications device. Congress recently amended the law to criminalize anonymous harassment via the Internet (PDF copy of bill).

Some argue that the law curtails freedom of speech. Perhaps. If someone is blogging or commenting anonymously about a private citizen in an “obscene, lewd, lascivious, filthy, or indecent” manner ” with intent to “annoy, abuse, threaten, or harass,” it is actionable, according to the new law. But should someone have the freedom to do that? Apparently Congress doesn’t think so. What do you think?

Tribe's plagarism should be considered in context

To the editors:

We are a group of Professor Laurence H. Tribe’s current and recent students, research assistants, and teaching assistants. In our view, the Crimson’s recent coverage of the allegation that Professor Tribe in a 1985 book inadvertently failed to give proper attribution to a book by Professor Henry Abraham simultaneously (News, “Prof Admits to Misusing Source,” Sept. 27) overstates the seriousness of that allegation and fails to acknowledge Professor Tribe’s deserved reputation as a scholar.

As you may know, a recent survey of 13,000 Harvard Law School alumni found that Professor Tribe is the most admired member of the school’s faculty, past or present. When Tribe was just 35 years old, Time Magazine included him in a list of the ten most outstanding law professors in the United States. He has helped author the constitutions of several emerging democracies, including South Africa, Russia, and the Czech Republic. He has argued more than 35 cases before the Supreme Court, and he has won most of them. His masterful treatise, American Constitutional Law, justly dominates the field and is cited far more than any other text of its kind.

Although Professor Tribe’s book, God Save this Honorable Court, acknowledges the work of Professor Abraham as the leading contribution to the field, it does not specifically attribute some language in a few isolated sentences. Professor Tribe has sincerely apologized, and that prompt acknowledgment should be the end of the matter. Because the concern has not been raised in the many years since the book went out of print, there is nothing more that Professor Tribe can do.

Such an isolated error—emerging from the gloaming after two decades—should not, and will not, tarnish the reputation of America’s leading and most creative constitutional scholar. The country and the legal profession should be as proud and grateful as we are that Professor Tribe continues to work as hard and conscientiously as he has for the past forty years.

In response to Fertik's suckup letter there about the tribe, someone wrote a long satirical letter to the crimson about it tearing him apart, and implying that he's incredibly gay and a ridiculous brownnoser

That was it. Fenno had to get out of there. He exited the side door of Langdell North and made his way into Pound. Lying on one of the seats in the hallway was a copy of the undergrad Harvard Crimson. Fenno thumbed through the pages. In the editorial section, he came across something rather unexpected: a letter submitted to the Crimson defending Professor Tribe against charges of plagiarism, co-written by seven current and former HLS students. Fenno read the letter thoughtfully. It generally noted how well-regarded Professor Tribe was by alumni and practitioners, and in how much esteem his scholarship was generally held. Fenno re-read it again, to ensure he hadn't missed any of its finer, more nuanced points. Reflecting prudently, he then reached his own carefully wrought conclusion about the letter: what a pile of crap. As if it's somehow okay to copy passages verbatim if everyone agrees you're a swell person in general. Fenno was a super guy, too - especially according to the girl in Washington - but he had a feeling he wouldn't get away with lifting quotes wholesale. If so, he was really looking forward to exam period for once.

While reading the letter in the Pound hallway, Fenno passed by the wall of professors' portraits. Curiously, he noticed that Professor Tribe's frame was missing. That's odd, thought Fenno. Where did it go? He continued walking down the hall. As he passed by a dimly lit Pound 102, he heard strange noises. A sucking sound, or slurping, or something like that. Peering through the door window, Fenno made out the figures of two of the co-authors of the Crimson letter, Michael Fertik and Dan Richenthal. Fertik was holding something up close to his face. It appeared to be the missing Tribe portrait.

"Mmmm... yeah. Just like that. That's how I'd do it." Fertik mused dreamily.

Richenthal grabbed the portrait from him. "No way," he responded. "If I got the chance, I'd do it like this." With that, he moved his face toward the frame and planted his lips softly on the glass. "Yeah... that's nice." His mouth roved the portrait glass sensually. "Mmmm. Good stuff," Richenthal murmured delicately. Fenno thought he glimpsed a little tongue.

Fenno just couldn't let this opportunity go to waste. He swung open the door and called out to the two 3Ls. "Hey fellas! What's up?"

Fertik and Richenthal turned toward Fenno, horrified. Richenthal dropped the portrait, which crashed to the ground. Fenno hadn't seen Richenthal in quite a while; he wondered what he'd been up to. It certainly wasn't charm school.

"Er, uh, hey Fenno! Um, what are you doing here? I thought you had con law right now."

"I cut out for a little while... say, guys, great letter to the Crimson. Really made a good point."

Fertik's face lit up. "You think?"

Replied Fenno, "No, of course not, you sniveling mass of back hair. All you did was basically admit that Tribe plagiarized, but then said it's okay as long as the guy is admired by others. I mean, what the fuck?

"You don't get it, Fenno," replied Fertik. "It's all about the context--"

"Oh, bullshit, it's all about the context. You either copied or you didn't. And by the way, did it really take seven people to write a four-paragraph letter? Did you actually divide up the twelve sentences, or were five of you there just to pat each other on the back?"

Retorted Richenthal, "Suck it, Fenno!"

"From the looks of it, you seem to be taking care of that," Fenno answered coolly. "By the way, be sure to wipe down those smudges before you put the frame back up. You don't want to leave a mark." And with that, he headed out of the room.

Fenno found himself back in the hall. He figured he should probably get back to Fried's class. Outside, the skies were already pitch dark, and the wind looked to have picked up. Rain was threatening. Gotta love those Cambridge falls, thought Fenno. Or was it winter already? Sometimes it was just too hard to tell.

On the question of corporate influence in politics, and how its more corrupting aspects could be avoided, his prescriptions were far less simple. "More or less, it comes down to the types of people you elect," he said. "It's one thing if [a candidate] comes out of business but understands that there's a separation between his or her life in business and his or her life in the private sector. But when you have a Dick Cheney, who takes his business allegiances with him, that's another matter." When I asked him how one could expect to tell the difference before we elect them to office, he admitted that it could sometimes be difficult. But he said one could, in talking to candidates, manage to "get a read on" them.

It was a fair answer, albeit an unsatisfying one.

P.S. I know Michael Fertik, the CEO of this absurd company. He sat in front of me in one of my 1L classes. He was a pretentious gunner who wore lots of Armani. The last time I saw him, he was standing in the D.C. Metro bitching about how haaard it is to be summer associate because he had firm events practically every night. I think my response was something along the lines of "yeah, it sure sucks to be massively overpaid for a summer sinecure and expensively entertained non-stop." I don't think this was the reaction he was expecting. He's ridiculous and I hope his company tanks.

POLITICS: ‘Loose Change’ Close to Treasonous

The Kitsap Sun recently carried an announcement that the Kitsap Unitarian Universal Fellowship would show a film called “Loose Change” at their building on Perry Avenue.

The film claims that Sept. 11, 2001, attack on the World Trade Centers, the Pentagon, and the crash of a passenger plane in a Pennsylvania meadow … are NOT the result of terrorists, but rather a cleverly executed conspiracy by our own government people.

Ordinarily, I would not dignify such an announcement with a comment, but the level of preposterousness keeps urging me to do so.

Obviously, such a film is a sham, to influence politics and to bring shame upon our country. I feel the authors and the KUUF should be judged close to treasonous.

Similarly, a story was promulgated at the start of World War II that President Franklin Roosevelt started a war with Japan so as to boost us out of the Depression. Both cases are at a level of ignorance beyond description.

We need organizations that have a higher regard for USA.

i think what got us in trouble was using their logos (photoshopped, of course).

the rest is just factual information... so that's an adjustment we'll make. and then relaunch.

they just disabled our ability to make it visible.

therefore, it will be fairly easy to move the content elsewhere.

this will be done soon--i dont have much time, but i'm looking for others to get involved. this is an open project... this could be done in less than 1 hour. but someone needs to help.
