Are you offended that I went to an in-state school and pay ~13k tuition and have a biglaw job you will be fighting for next fall already in hand?

I also have a biglaw job in hand. But yes. Looking at the debt I'm going to graduate with, I might have been better off taking a free ride somewhere like Michigan or something. If I knew I was going to be good at law school exams, I might have.

EDIT: In hand is an exaggeration in my case. I will have an offer to return 2L. That's different, I suppose.

Well, you will walk on to the job regardless. The key difference I was trying to highlight is my debt will be $75k max, and that is with several international trips included.

No doubt. I wish there was some sort of bonus structure to account for 1) debtload or 2) success in law school, etc., but I don't know if there is. Obviously there's 200-250K for SCOTUS clerkship, minus 2 years biglaw salary (v. clerk's). That's a longshot.

Keep looking on the bright side, maybe you will get a degree that is all in latin and look really cool for the rest of your career.

Seriously, though, don't underestimate the ability to walk into biglaw. People agonize over that shit, and basically would give anything to get a biglaw job.

If you are an A average at a top school, though, why not go for the SCOTUS clerk? the 200k bonus more than makes up for the shit salary. You may have to postpone models+bottles for a couple years.

Which justice would you most like to clerk for? Scalia?

Date: July 6th, 2007 12:25 AM

Scalia would be a lot of fun. When I graduate, there may be another Justice in Stevens' seat (or Ginsburg's, for that matter). But if the Court were as it is today, I'd really like to clerk for Justice Kennedy, if only because it would mean helping out on the most important opinion in almost any divisive case.

But you would have to deal with his pussy vacillating. Of course, you could be the clerk who gets to stick is finger in the wind to see which way the opinion will blow. I suppose that would be satisfying. Almost as much as the love of a mother for her child.

There is something serious to respond to in here... I'll take your comment to mean, "But then you'd have to deal with a Justice who struggles with every single decision, and that will be both frustrating and tiring."

To that, I'd say it's a good point. On the other hand, that Justice Kennedy struggles with each decision and takes his job very seriously is admirable, and I think struggling is the best way to arrive at a reasoned solution.

I like "dandelion soup gang" very much. "Shoot 'em up gang" is slightly less artful, but I suppose then that's the point.

Scalia and Ginsburg do enjoy going to the opera together, so there may be some dandelions in Mr. Shoot 'em up's soup.

Here's the problem, friend: suppose you have a > A average at one of those schools and want to avoid outing. Y doesn't even have "A," let alone "A+." I'm willing to bet that some of the others don't have A+. You can narrow it down that way. But I don't want to further specify if doing so would narrow it down to one school. This is especially true when people at the very top are more easily identifiable.

So I appreciate your concern, and I apologize for not starting an approved thread. Should I petition Rach for his approval, or can I just appeal to you?

i'm going to go ahead and give you the required waiver, and on a couple of grounds. first, you make some good sense with your point about the grading scales. second, those of us in the know and with a mathematics background recognize the ">" symbol as indicating "greater than." thus it would appear that your GPA is greater than an A. that is an undeniably high average. sweet jesus, i could be corresponding with a future supreme court clerk and faculty luminary at a place like the university of harvard! it is i who should be asking you for special dispensations.

I spend a lot of time thinking about what my professor is going to want to see on the exam, and how he/she would like to see it presented. The best way to do this is to study carefully every A exam answer for a prof you can get your hands on, obviously.

I also look at the questions themselves (over time, if multiple exams are available) to limit my studying to a very small subset of the information covered in the year. I determine what are the subjects I am very likely (and somewhat likely) to be tested on. I study the "very likely" ones so that I *understand* them really well, such that I can apply them, though I don't focus much on cases. I do use supplements.

So, for example, if a Torts prof spent weeks on intentional torts but all his past exams are almost entirely negligence, I practice negligence analysis like hell and pretty much ignore the intentional stuff.

Not much, and what I take is almost never useful at all. I do have a very good memory for remembering broad themes in terms that professors use. I think that if I didn't have that skill, notes would be more important. I definitely think people get too caught up in the day-to-day crap, though. 95% of each class will have no bearing on your exam, and most of the stuff that does matter will come back again.

is it just me or is 95% of the learning for the exam stuff you glean from E&E and emanuel's? when you started doing your outlines, how did you go about putting them together?

I start with the syllabus, as I think most people probably do. I sometimes skim the cases (sometimes google/wikipedia or something), spending no more than 3 minutes per case. Then I'll look at (but not take) a few practice exams to get a sense for what's tested. Then I'll start making a <10 page first cut outline, which is mostly checklist style, but more detailed on the areas that are more likely to be tested. This is where I use the supplements. Any area I don't understand, I turn to the supplement, read the relevant section, and then go back to the skimming cases for a bit.

After I get through a <10 pager, I like to make a 2-4 page outline/checklist. Then I practice exams. I actually write full answers (this is the bulk of my time studying) to every exam I practice. I do as many as are available, but I'd probably do no more than 10 if more than 10 were available. If I'm really doing well after 3 or 4, I stop. There's no point in killing yourself if you've already got it. Then maybe I'll skim the supplements.

I'm not a fan of E&E by the way.

I understand that. If there are cases that are repeated (by the prof) over and over, I do know those cold. That's one of the things I get from my notes. I write: prof mentioned Palsgraf again, learn that one.

The weird thing about casebooks is that you have excerpts of cases that are there for all sorts of reasons. Some are ONLY there to show that a minority view exists that goes the other way. Others are ONLY there to make a procedural point of no value on the exam. The first of these can be ignored if you pick up a good supplement that tells you whether the rules are universal and, if not, what the minority rules are. The second of these can be ignored completely.

It's hard to know these things in advance, but that's something to look out for in class too, I suppose.

I don't think my profs would have done it, and I would not have felt comfortable asking. I was lucky in that I had access to A answers and lots of past exam questions for most of my fall classes. For the one I didn't, the prof provided pretty detailed info as to what he/she preferred. I think it's important to listen to your prof for what he/she wants, though you should realize that some of it is just stuff they say they want because they think it'll get you to study more or something.

That's a hard call. Today, I think no. I've done it enough that I can get a decent sense just by looking at lots of questions, even without answers. But back in the fall...I don't know. I'm probably too awkward to feel comfortable asking. It would depend on the prof. It could only help, I suppose.

EDIT: Sorry, ignored the study group question. Yes, only to go over past exams the week or two before the exam. This also helps me to know I've got it.

Better off than the other way around, probably, but that depends on the types of exams you run into. If you have in class exams, you are in rough shape without a bit of practice.

My advice to you is twofold. First, consider prewriting pieces of in class exams (if possible at your school) with any profs with mildly predictable exams. I don't do it much, but I have heard it's effective. Second, look over A answers for the structure of a good answer. Don't just read them, but analyze what they are doing. There's probably a book out there that does this well (Getting to Maybe? I didn't read it). It's not just IRAC, for sure, but that's something.

I suspect that the government might run into constitutional issues regardless of the program, though I couldn't say for sure. I suspect tax breaks might be particularly effective.

That said, while I recognize that you have a strong interest in uniting WG with AG, I wonder why the government would share your concern. In particular, because this would most likely require legislative change, I wonder what would compel a congressman to spend valuable political capital when only fringe groups with very little money are interested in increasing WGWAG.

This is exactly the thing you can write to your congressman about, and his staffers will send you a sincere letter in which the congressman pledges his commitment to make this a better country, hopefully by pushing for WGWAG legislation. That's about as far as I see things going though. Perhaps it's worth it: I suspect you might enjoy wallpapering your WGWAG room (where you watch movies featuring WGWAG) with the letter from your congressman.

Found it, sure. I doubt it will be effective. You need to change the way people look at the relationship. This is where I would suggest a media conspiracy as your best bet. Big movies starring the Asian version of Brad Pitt (if one exists) and the American version of Angelina Jolie. A remake of Mr. & Mrs. Chang, perhaps.

I don't think my week-to-week study schedule is something that anyone should emulate. I sometimes fail to do the reading entirely; I often merely skim for the holdings; and I typically do less than is expected. In a Socratic class, this means that I am sometimes called on when I just don't know the answer. So it goes. I try to stay up on the policy stuff, since that usually gets me by in class (plus skimming the case as we go over it).

In answer to your question, probably about 30 to 45 minutes for the the typical class, though it varies widely. I will also designate a weekend here or there for hardcore studying (say, 14 hours). Sometimes you need to catch up. Other times, you realize that the last two weeks of class don't matter, other than for the experience.

do you find yourself typing non-stop from the beginning to the end during the exam?

Depends on the exam. Some have page limits, so no. Others don't have page limits, so often yes. This is also a function of looking for what the professor wants based on past exams if possible.

Where there are no page limits, I'd be willing to bet that there's at least a rough correlation between length and grades.

when did you become confident that you are on the right path with the way you are studying? What did you do during the summer before school started?

I wasn't confident until I met with my study group, and I wasn't sure until I got my fall grades. It honestly FEELS like a crapshoot. But since it's repeatable, I'm more confident now. I don't think grades (at the top or bottom anyway) are random, as many say. I'm biased of course.

I do think that different things work for different people, but I feel confident that "learning everything first and then starting to look at exams" is a bad idea. You can usually cut out a minimum of 30% of the crap from the semester, and if you're good about it, sometimes as much as 80% of the crap. Look at exams.

EDIT: I ignored a question unintentionally, but now I'll have to decline to answer. I think that I might be too easily outed if I put down my employment.

I think it would depend on the course. It was certainly a workable timeframe. Note that I didn't do any outlining until AFTER that, though, so it might be too late for some.

do you think there's any point in doing this 2 week "law-preview" course that my school is offering? apparantely they teach you some skills on memo writing, studying for exams, etc. they also go over each 1L course in a 3 hour class (one class per weekday).

does shit like this really ever help?

bump. good thread. HYSCCNanon, I found that your focus on A answers was the way to go. As much as learning any specific doctrine, what mattered for me was learning Professor X's habits of analysis -- the DNA of what they thought a good answer did -- so that you could sort of mimic it on the exam. I tell people that what the professor secretly wants to hear is the mini-version of him you've spawned in your brain after weeks of sitting through his brilliant lectures. After you get this, it shapes and speeds up note taking, outline prep, etc.

The other thing was how important it is to only skim the cases before class. A well written opinion is as easy to skim as a TV guide, because all the sections are marked: rule synthesis/application/counter/conclusion, then repeat. The important thing is finding the puzzle in the case and thinking about that a little bit. I was always amazed when I would skim a case for five minutes before class and then I'd end up riffing with the professor about it in class, while people who still cared enough to sweat over it got left behind. Not that talking in class matters.
