This may or may not have changed after health care reform last year. Haven't read much on it lately, but I remember reading that things may have been loosened up a bit (to try and protect against Medicare type fraud...but the changes weren't specific so the courts will have some work to do).

False Claims Act 31 USC 3729-3733. The qui tam part allows the relator to recover i believe 15-25%. However, the relator must be the original source of the info unless there has been no public disclosure. Obvious public disclosure issues here. Also, the fraud against the gov't is somewhat tenuous.

the false claim would have to be school specific anyway so its very possible to imagine a scenario where a schools specific fraudulent claim is not public knowledge. Realistically you'd need a whistle blower coming out of the administration, financial aid or admissions office. The 2009 amendments to the act change the definition of what is a claim and what is a false statement making things much easier for plaintiffs.

Also, there are state FCA's that often are way better to sue under than the Federal act. The NY FCA in particular is kinda awesome.

Seems like there would have to be a bit of a leap here. the theory would have to be "misleading stats get people to go to law school. these people finance it using federal loans and then default bc they cannot get jobs." Did the fed gov't rely on the employment stats when giving the loans? Honestly i think it's pretty weak.
