This is the prole take that equates "bankrupt" with "gone forever." Red Lobster is the classic case of a business that has good parts but with too much debt/retarded contracts. Pay creditors pennies on the dollar, reject/renegotiate too expensive leases, make unlimited shrimp a seasonal thing, reject/renegotiate retarded contracts, only keep open the good locations and bam, you have a viable business again. Their chances of a sale of their good assets as a going concern are good.

What's more, they have to receive at least as much as they would under a hypothetical liquidation or the plan is off. And the restaurant will continue to exist as a going concern. no shit if every creditor would get paid they would insist on a liquidation. who THE FUCK declares chapter 11 in this instance though? the entire point is to force creditors to accept less favorable terms.

Yeah, the non-priority creditors are out of the money but they're going to get paid more than they would in a liquidation assuming a successful sale. The employees will get paid up to the priority cap which will probably cover everything a typical Red Lobster employee is owed. Yeah, some trade vendors and (((banks))) will lose out, but they know the risk they were taking doing business with a company that's been distressed for years. A good restructure like this, if it works, is an example of a restructure actually working.

You're sperging out in the other thread about how Red Lobster was destroyed, but you're also MAF that a process exists to save it.
