-She falsified patient records (several extractions were magically done in one evening) to make it look like she did work she didn't do -...work that was required of all students by the school as part of their hands on training. The "$38k" was some arbitrarily assigned values to the required procedures, in an attempt to teach the dental students about business practices/thinking about production in terms of $. The work was all free and provided to needy community members.
who knows what really went down but they're probably both terrible |

They could have just let her graduate and then made her make up the missing $2,000 in procedures. BUT NO. They would not let her do that and would not give her any more clients, so she had no way to come up with $2,000 in billings. Then her advisor told her she would just have to pay for the difference herself and she did.
Allegedly the advisor was the one that told her to create the records which were for the exact amount that she was missing. Everything was charged to her credit card. If she was trying to truly doctor the patient records, she would not have made one credit card payment for all the procedures. The whole thing is fucking retarded and NYU should have used more common sense. Even if she was guilty of bad judgement blah blah blah expelling her was a completely fucked up thing to do.
The appellate court 100% got it right and pretty much reamed NYU in its opinion. |

She claims she had been informed by her supervisor that to meet the revenue-generation requirement, she needed to pay out-of-pocket and attribute the payment to clinic work. Backing up this claim is Kickertz's cash and credit payment to NYU in the exact amount of her PMV shortfall.
Furthermore, as the appeals court in her case noted, NYU has to date not produced the actual "falsified" patient charts in any court hearing or during any internal disciplinary hearing. Thus, the factual basis for NYU's misconduct claims against Kickertz is lacking, and had she been able to defend herself she might have been exonerated on the merits. |
