John Steele, then Partner at Fenwick & West, fired Tucker Max in the charity auction story.

http://www.tuckermax.com/archives/entries/the_now_infamous_tucker_max_charity_auction_debacle.phtml#703

Tucker quotes him as price fixing SA salaries : “Yeah, what kills me is that we had a deal with Wilson and Cooley. We all agreed to pay $2,100. We talked about it, and figured as long as all of us did it, we could get away with it. But as soon as we announced, that message board blew up, and Wilson bailed on us and paid $2,400. That thing is something else.”

He is also an ethics teacher at Boalt.

Does this blow anyone else's mind?

I don't really get why it's unethical to fire an employee who's been given about 20 chances and f*cked up every time... maybe I'm slow.

Bump! Hell, doesn't anyone care about this??? He gave all of the 1Ls a long lecture on how we need to guard against temptations of unethical acts! His class is required to graduate!

This doesn't seem to be unethical by any of the standards governing attorneys. It's also not price-fixing, it's salary-fixing. Firms all over the country do it, both for bonuses and salaries.

I understand that you are right, but how he is portrayed in the TM story is very different than the impression he gave off when he gave the ethics lecture to us all a month ago.

he *has* to make that impression to be a credible ethics instructor. but don't worry about it much. it's an easy class that's taught at night. most people don't go and do well. i have a buddy whose exam is sometimes passed out as a model answer and he said he bullshitted the whole thing for a HH.

Would he be annoyed if I asked him about Tucker Max? Are any of the other ethics classes worthwile, like "ethics in non-firm practice"?

it's basically the same class, with a slighly different perspective. it really doesn't matter which one you take. neither one is better than the other. i am taking the non-firm one to fulfill the req. even though i'll be working at a firm.

edit: i think an ethics instructor ought to be open to such questions. you should definitely ask. i can't promise you that he won't bullshit his way out of it, but yeah, try.

are you kidding me?? this is such an old story. Steele even talks about it in class, mentions the website, and we all have a laugh about it and move on. If you're this easily shocked you're going to have a really hard time.

um, since neither of us have taken that class, we wouldn't know that he talks about the incident. i guess we can look forward to steele's version when we do.

What blows my mind is the utter idiocy of this Tucker Max character.

First, I have serious doubts as to the veracity of the story.

Second, even if it were true, all it shows is that this guy Max is a giant douchebag-loser-fucker.

OP: I'm not sure why you think it's odd that Steele teaches ethics. In that entire horribly-written story, the only unethical behavior I could identify came from the author.
